Seller left bogus tracking number and then lied to e-bay.

Should I contact the Attorney General when the seller gave bogus tracking number and lied to e-bay?

 

I tried to appeal, but the seller said the item arrived when it did not.    I could not even leave negative feedback.

 

If anyone wants the seller's shop name I will be glad to give it.

Any time you file an "item not received" claim with eBay, and there is tracking that shows something was delivered somewhere, you are going to lose.  

You first need to contact the carrier i.e. USPS, UPS, FedEx etc. to determine if the parcel was misdelivered or not intended for you in the first place.  eBay is going to require "written proof" from said carrier which is often impossible to obtain.  If it was a "sports card" or other item using eBay standard envelope shipping, that tracking leaves a lot to be desired, and often is marked "delivered" a couple of days in advance of arrival. 

 

Once it is determined the parcel was misdelivered or sent to an address in your Zip Code, intentionally, you can appeal on eBay if you get the required document.  This is usually accomplished by contacting eBay via one of their social media portals.  These are monitored by US eBay employees that are quite familiar with this scam, and actually have the authority to help you.  One of these is to use the blue message button at the top of this page.

Ask them what they need.  If your seller has been making a habit of this they may already have been kicked off the site, so your requirements as a victim may be minimal. 

If eBay throws you under the bus, you can go to PayPal or your credit card company for redress.  DO NOT DO THIS AT THE SAME TIME.  You will have to give up the idea of "item not received" and go with FAKE TRACKING SCAM if you file a claim elsewhere.  Otherwise, when the claim is submitted to eBay, they reply with the same (fake) delivery confirmation and you will lose again. 

It is interesting to note, that PayPal has added a new selection to their dropdown menu when filing claims "Delivered to wrong address" or something of the sort.  We have had very little information on how this works, or if it has been useful, or what information they might require.  

Another option that some have used (to beat eBay at their own bot game) is to file an  "item not as described" eBay claim.  The seller will have three days to provide a return shipping label or refund, before you can return to the case and escalate (ask eBay to step in and help).

So, same thing happened to me this week. BUT I was able to verify through UPS that the tracking number for my purchase was falsified by the seller. Confirmed through UPS that the tracking number was from AMAZON (not Ebay), the dates did not coinside with when I won the auction through Ebay, and wasn't sent to MY address. Unfortunately I found all of this out only after my appeal was denied 😕 BUT I have an open claim with PayPal now with all of this info. Just curious now if I should change my claim description from "item not recieved" to something else all together.

Yes.  Contact them to change it to "fake tracking/shipped to wrong address"....

Yes you should @kkirk820 as you'll also lose "item not recieved" at PayPal, because tracking shows delivered.

 

Instead click the "Change case type" button at the bottom of your PayPal case, to change your case (and @catmonday open a case here) for "Item was delivered to the wrong shipping address" like this:

it seems that you had a very bad experience with your Attorney General.   I am sorry to hear that.    Let me know if I can help you in anyway when you contact the Attorney General again.  Perhaps your communication with the your AG was improperly worded.    Also, you should post your communcation (redacting your given name) with the AG team.    I am interested what was their response t you.

i did not use paypal this time, but the genuine responses to my initial post must have provided visibility.   I am getting refunded.  It seems the mail got stolen.

No, because the AG's office is more interested in corporate or large retail fraud, than individual fraud cases. You could file a case with the USPS postal inspectors whose powers extend to other shipping agencies like FedEx or UPS  for postal fraud. However, because scammers probably gave a fake return address and name, chances are they will not be able to help either.
