Ebay screwed me out of 931$ because they could not see the delivery address was incorrect

I bought a lower priced audio console from a seller who sent this to a gas station, instead of my business.

I sent them the corresponding USPS document that shows the wrong address.  This was clear as day but they ruled in favor of the seller.  The other problem is you cannot get someone by PHONE!!!!!  They closed the case, and i am at the moment screwed out of $931 as I am working with Amex to try to get this corrected.

Ebay has no Buyer protection.

Except for

-- incorrectly starting an Item Not Received case at eBay

-- then losing the case because tracking shows something was delivered somewhere

starting a chargeback at Amex was the best move.

 

Give Amex that USPS document which shows the deliberate delivery to the wrong address. Emphasize that this is false tracking, not an Item Not Received case. Otherwise eBay will win again @kpp5 by simply refuting with the same tracking number showing delivered.

 

There's a chance that the seller will still keep your money, and eBay will pay for your refund.

 

That's because the seller won the INR case at eBay, so eBay protects the seller and covers the refund for any ensuing INR case against eBay. Otherwise, the seller will pay your full refund including eBay FVF and your sales tax, plus a $20 penalty.

This is a huge problem that ebay refuses to address... If anything attached to the tracking number is delivered anywhere in your zip code, ebay's automated bot system rules in favor of the seller.  The only way to deal with ebay in this regard, is to do a bunch of legwork.  You would need written conformation from the carrier/shipper that they didn't deliver to your address.  This is a common scam, you would also want written confirmation that the item wasn't addressed to you.  Then you'd need to present all this to CS.  It's a total PITA, but that's ebay.  I hope you'll get a better result with Amex.

I did as it cleary states that on the USPS document that it went to a different address, but this still did nothing about this.... It is so unbelievable.....

American Express is rather good of disputing a charge and getting refunded. Best way to dispute a charge is online...not by phone by the way.

I looked at some of your other awful purchases...and have to say...those negative feedbacks are probably warranted. However, look at sellers feedbacks before making purchases...those sellers have rather poor feedbacks or no feedbacks as a new eBayer.

"cannot get someone by phone"...even if you did get someone it wouldn't help much...just a big headache.

That is because a standard "item not received" case will not work if the seller provides tracking that appears to show delivery to your area.

 

Instead you must contact eBay via social media, use the term "false tracking" and then provide your documentation that shows the tracking number does not correspond to a delivery to your address.

Did you by chance happen to have an old delivery address with eBay? If so, the incorrect shipping address issue is a known issue. In fact, eBay recently sent out email messages to some sellers informing them of the glitch. I didn't receive one personally, but if you can find someone who can share that with you, it will pretty much be a slam-dunk for you. 😉

How did your account have the wrong address on it? Something smalls fishy.   The seller does not create the address.  It is loaded from whatever the buyer has as the delivery address on the buyers account.  So where did that address come from?

The original poster did not say the address was associated with the account.

 

The seller appears to have provided a tracking number for a shipment that was delivered to a nearby business location -- which is either an extremely unlucky coincidence, or (more likely) an example of "false tracking".

That is exactly what they do for a "fake tracking scam" scenario.  They send some cheap package to another location in the buyer's zipcode.  It works to fool the eBay bots, and the regular customer service you get in a call back or chat, even if they understand they usually have no authority to help. 

In this case the Money Back Guarantee is a FAIL for buyers, unless they know how to proceed.  They need to abandon the "item not received" issue if they go to PayPal or their credit card company for help, and make it very clear it is a fraudulent "fake tracking scam" instead. 

Since the OP, @kpp5 has already contacted American Express, they need to MAKE SURE they don't push the "item not received issue" and pursue the "fake tracking scam" instead.  Now that the OP has gone to their credit card for help, eBay is no longer obligated to help. 

This is nothing new.  You can read about some of these here.  These are basically just from the Buyer board starting in Jan.  The scam can be traced back in these forums to at least 2013.

Soooo - my USPS friend, unofficially - so take this as conjecture, suggested to use the process in place & to not claim the item was not delivered, when there is a delivery on the fake tracking number. Claim it was not as described, force a return label, ship a package back containing a printout of transaction details with the label & get refunded upon delivery.

 

This was suggested as a potential faster method of resolution since carriers have the position of denying claims with delivery confirmation initially. Likely was also suggested to try & remove the issue from their desk...but it could be more effective.

I always contact eBay on the "eBay for business" Facebook page and chat with them. You can attach photos on there. Worth a try but otherwise I don't have any advice.

It did not have the wrong address..... same address i use on every order.  I have no idea, but the address was a gas station.  Your reply smells fishy.

Your address on eBay was correct.  The seller either used that eBay label to retain the bar code/tracking information and altered the address to that of your local gas station (easy to change the PDF file of the label to reflect an address different from yours) , or purchased their own label to send the 'cheap trinket' or sent an empty box to the gas station.  So long as it is to your same zipcode, the eBay bot and customer service is fine, the scammer wins the case, and you are out your money UNTIL you do something else that does not involve the automated denial system, outsourced eBay customer service, or pursuing a refund without evidence that the parcel was NOT delivered to you.   You need to pursue FAKE TRACKING SCAM FRAUD, not item not received.
