Seller sent package to random address in my zip code and my appeal was denied.

The seller sent a package (what I believe to be an empty box) to an address in my zip code. FedEx says the package is delivered but the house in the delivery picture is not my house. eBay automatically closed my case because the package shows up as delivered. An agent confirmed that the seller did not use the eBay provided shipping label. How do I get eBay to investigate? It’s very frustrating talking to agent after agent. They tell me to file a claim with FedEx however FedEx says that my address isn’t the address the package was sent to.

I’m gonna try the payment source method if I can manage to get something from FedEx, I have a feeling that eBay will continue to ignore the evidence even if I get a signed statement.

eBay has been requiring WRITTEN NOTIFICATION that the parcel was not intended for you.  eBay knows that this is difficult to obtain, and likely why they are requiring it.   You are also facing the issue of claims/returns/refunds basically being an automated process on the eBay site.  That is why the eBay Money Back Guarantee is a FAIL for buyers that are victims of this scam with a recorded 'delivery' of something to somewhere.  The eBay customer service you get on chat or call back are outsourced people in foreign countries with no real authority to help.   eBay will do nothing to verify with the carrier that the parcel was not indented for your in the first place.

This has been going on for YEARS.  For a while there was a website that would show the actual STREET ADDRESS for which these parcels were intended, and actually delivered (except for USPS).  It was a godsend for victims here, but unfortunately short-lived and that information is no longer present.   USPS was very uncooperative, but over the last couple of years is basically sick of this as well, and are more helpful. 

Whether you seek redress though one of the eBay social media portals (recommended) , PayPal, or your credit card/bank, you need to STOP insisting this is an "item not received claim" and go with the "fake tracking" scenario instead.  Otherwise,  the payment dispute will be sent to eBay, who responds with the same old evidence of delivery, and you will lose again.  As suggested upthread in message #10 by @sdneped ,  if you used PayPal to pay, they have a "new" selection available just for this situation when making a claim.  I have not seen any reports on how it plays out, but it is a good indication, that unlike eBay, they are taking note of the situation, and may accept other than written notices from the carriers.  Do report back if you use this. 

Once you file with PayPal (if you paid that way), eBay is no longer required to be of assistance.  If you file with your credit card while your PayPal claim is active, PayPal is  going to dump you, too.  So don't be in a hurry and file everyplace at the same time! 

Another option in the past, though not recommended, would be (before you seek redress with your payment source) would be simply to change your eBay claim to "not as described" and follow the protocols for such things as "missing parts or pieces".  The seller will have to respond with a return label (or actual funds if out of the US) to return  the "something" you didn't get.  Anything will do, and any photo you put up there to file will probably work, too.  If you get a label, it might be fake, too, so I would read up on this prior, or not use it at all. 

Know you are not alone.  These are from JUST this board, and I was told there were many more posted in other sections of the community as well.  Being a victim of this is not as dismal as it used to be.  Again, do come back and let us know how it works out for you.

This happened to me over a year ago ... and involved all 3 major shipping companies (different transactions).  I believe I used this number for FedEx:  1-800-463-3339.

 

Either UPS or FedEx (I forget which) had a 'Fraud Department' that I spoke to after calling their 800-number.

 

BTW, I recall someone else posting that FedEx had refused to email them the document as well.  I recommended that they keep trying ... and they posted back that they eventually got a hold of someone at FedEx who was helpful.  I think it was more 'finding the right person' than saying any certain thing.

 

Good luck ... and please post back as to whether you were able to get a statement emailed to you.

I was able to get a personal email from the senior manager at the FedEx Shipping Center a couple towns over confirming that the package was not addressed to me or my address. Unfortunately eBay still isn’t helping me. I was basically told that since the appeal was already denied there was nothing more I could do…

Stop talking to eBay, or the seller, or FedEx @m8p67-99 any more.

Instead now that you've lost the case at eBay, proceed upwards to file a dispute at this page if that's how you paid. Upload anything you have which might help with the dispute.

 

Don't contact or respond to your seller again, and just wait for your refund. Otherwise or to continue upward, file a chargeback with your card issuer with the same evidence, to get your refund.

If you read what I wrote in the link, you would know that ebay will not accept emails as proof of non delivery because they can be faked.  You have to get the information in writing on FedEx stationary, and since you lost an appeal you have to use their social media sites to Appeal the decision of the original appeal.

As I explained in the link, It is the privacy policies of the shipping agencies that are the problem. They only feel that the sender is allowed access to the shipping label information. Since the sender is the shipping agency's customer not ebay or the recipient.  That and ebay's initial INR system which uses a computer to search a tracking number, for a Delivered scan and nothing else. Just as what you would see if you entered the tracking number into their site's tracking system.

What I meant by “look at the shipping info” is the FedEx tracking information page will tell you that the package was not addressed to my address… that should be all that is needed. They shouldn’t offer a money back guarantee for not getting your item if they won’t investigate claims of buyers not getting their items. It’s painfully obvious what’s going on by simply looking at the tracking page. The package in the picture can’t physically be what I ordered and literally has someone else’s name on it and that same name on the front door.

It’s time to contact the Fraud Department of your credit card company.  There’s no point in continuing to try to get eBay to take action.

After tons of back and forth with eBay on social media and no luck I opened a dispute with my payment source and presented my evidence. The payment has been reversed.

Same exact thing happed to me! Opened a case, Ebay favored the Seller because it says it has been delivered.  It's NOT my house in the picture and the weight is wrong for the package.  I called FedEx and they did confirm that it was NOT delivered to my name or address but the city and state is correct.
