Local pickup gone wrong.

Hello, I recently purchased an item for over $400 local pickup. I went ahead and paid the seller immediately with paypal. I had every intention of going to pick this item up and have already paid the seller. However, some stuff happened with my car and now I do not have the ability to go pick the item up. I told the seller and it seems that they intend to keep both the money and the item because it was listed as "local pickup, no returns." Is this true? Can they keep the money and the item because it was listed as no returns? I have no way of going to pick it up.

Seller is out at least $11.90 for the non-refundable PP fees that were charged.

 

They have also been charged $40 by eBay for an FVF as soon as you hit purchase.

 

Have you offered to make the seller whole by accepting a partial refund?

 

Is it possible that the seller would be able to/open to shipping the item at your expense?

The item is 160lbs. I can't afford shipping. I would be more than happy to let the seller keep $50 but they haven't even mentioned that to me as an option.

Thats very surprising because most people do. You could also just rent a car to pick the item up. Failing that, you will have to call Paypal about this, and see if they can help you.

The seller is out the 11.90 Paypal fees, but not the $40 fee. If you can get the seller to cancel the sale, the seller would be refunded the $40 fee. So the seller will just be out the 11.90 paypal fee. Communicate with the seller that you will allow him to keep the 11.90 he will lose if he will just refund the rest of the money. If he won't cancel the sale, and if you can't pick it up, I would suggest going to the Ebay Resolution Center to see if there is a way to get your money back there.

One possible reason is that the ? out of the A is not a L, perhaps.

Well to be accurate, a refund is not a return. The seller could issue a refund for any amount they want.

 

Maybe tell them what happened on your end and offer to let them keep $20 of your refund. Or you could just ask for the full refund, which is what I would do. 

 

You didn't receive the product so the transaction never took place. There is no argument for the seller keeping your money. The transaction was interrupted mid-way, so they should issue a refund. If they don't, file a dispute with ebay and/or paypal. I don't see any reason why you wouldn't win in a chargeback dispute, which is why I think the seller will just refund your money if they have any sense. If not, remind them that paypal will charge them a fee when they lose the dispute in a chargeback, which they will.

Regardless of the reason for not being able to pick up the item a seller under no circumstances can keep the item and the money. They can either ship it at their expense or cancel the order. And i'm not sure why they told you the 40$ for fees wouldn't be refunded to the seller for ebay fees. He will not get the paypal fees back but will get his ebay fees back after he refunds your money. I would message the seller and offer to let him refund all except the paypal fees to be fair but if you get no response or you cant come to a agreement start a case in your purchase history to return the item under item not received. Ebay can sort out the logistics for you about it being a local pickup.  I deal with this all of the time with buyers in other states selecting local pickup on accident I lose a little bit of money i just cancel them under buyer requested to cancel the order or problem with shipping address. Even if he has no returns as a policy you never received the item so your not technically returning it. If you start a case I can guarantee you will get a refund as long as you state your case logically and clearly. And like I said at the beginning UNDER NO CIRCUMSTANCES CAN A SELLER KEEP THE ITEM AND THE MONEY.

You started a second thread.  Please read my answer on the first thread.

 

When you pay with PayPal No shipping local pickup is ineligible for buyer protection because it is an item collected in person.  That is in the PayPal user agreement. 

 

On eBay not received claims I believe you need to pay for shipping or have shipping offered free before you can claim you paid for an item but haven't received it yet.   The receiving part is on you to pick it up.
