Item was not delivered, eBay refuses to refund?

I purchased a Palit ProGaming RTX 4080 from a seller on eBay, and against my better judgement, I didn’t review their account very well before checking out. They had one other item sold, one review for an electronic book, and were outside of the US. I figured if something did happen, and I didn’t receive the item, I would be covered by eBays buyers protection plan. Well, I spent the $912, and I was provided tracking into the very next morning. That Saturday I get an update showing that the delivery was delayed because the “business was closed”. I had the item shipped to my home, which is not a business. The next business day I get notified that the package has been delivered, and was signed for. The name signed was not my name, and no one would’ve been home to collect or sign for my package. I immediately contact USPS, and they start looking into it. I receive a call from a local CS Manager who said that they personally followed up on the “package” and they believed that I had fallen victim to a non-delivery scam. The item was shipped to a local business in my area, and the tracking info had been spoofed to show that it was actually delivered to my home, when in fact it wasn’t. I received an email from USPS confirming that the package was never delivered to me, and wasn’t even addressed to me. I opened a claim with the seller; who of course denies it all and claims I’m trying to scam them. I finally get to the point to where eBay is willing to step in, and they side with the seller. I sent them the email, and even uploaded screenshots from USPS website showing where the first delivery failed due to the “business” being closed. I’m honestly at a loss because I have no clue what to do. I’ve appealed, but they came back almost instantly saying that their original decision was correct. I’ve called Customer Service and was told there was nothing they can do. I’ve opened a dispute through PayPal as well, and plan to also speak with my personal bank, but I can’t just lose $913. I had been saving for this card (not this specific one, but for a new card) for quite some time and can’t afford to just eat the loss. Any suggestions? I’m working on contacting USPS again to see if they can provide me with additional supporting documents. The whole listing doesn’t really add up in hindsight, and I’ve been completely blindsided by eBay’s unwillingness to help. I appreciate any feedback, tips or suggestions. It’s not like my account has a history of this. I’ve bought plenty off of eBay, and this is the first time ever, in the years that I’ve had my account, that I’ve ever had this happen, and my luck was that it happened on probably the most expensive thing I’ve ever bought online. If it's still within 30 days of the faked delivery @chomp00 and if you haven't killed eBay by scurrying to your bank

Be sure to make sure Paypal is FULLY aware of that letter from USPS showing proof that the item was shipped and delivered to a different address.

Thanks! I just sent them a message & pics (screenshots of paper-trail..Fedex, Ebay)

The Ebay Chat (or via phone) has NO WAY of supplying the Fedex receipt. Despite me TELLING them of the discrepancy (weight, shipping address NOT matching home-address, etc). However, in filing a claim, I WAS able to attach the screenshots. So, why was the claim *rejected* ?

I’ve already uploaded the “proof of delivery” from USPS showing where it was actually delivered, as well as the order details provided from eBay to the Seller, showing that it in fact not delivered to my home address. The PoD even shows that a business signed for the package with the business name. Hopefully that’s enough to prove it wasn’t shipped to me lol According to eBay, they provide my address, and it’s up to the seller to ship it where they say, so at this point, if they don’t budge, they must be actively trying to screw me. I’ve called several different PayPal reps just to let them know that I’ve uploaded supporting documents. They have to wait until the 14th for eBay to respond (which it’s very likely that they will) and then will have to fall back on my supporting info to make a decision. Hopefully it’s a clear enough picture to see what happened. I’ll tell you what, this has completely ruined the site for me. The only reason I even trusted this guy enough was because I was told eBay buyers protection will help if this happens, and that failed, so it’s up to PayPal now I suppose. Apparently the seller provided eBay info showing that the item was shipped to my address, so I’m hoping the form I have is enough to show that it wasn’t.

Ebay (via Facebook messenger) is telling me they can't help me, since I escalated to Paypal claim (immediately decline) after Ebay denied my appeal! But, in my Ebay appeal I CLEARLY stated the shipping discrepancy (weight, signed by TTALIN, fouled up ship & delivery dates, etc) which indicated a FAKED delivery

It appears as if Ebay has doctored the info, to avoid doing a refund on an OBVIOUS crooked Ebay seller!

I just communicated this to Ebay (over FB), & demanded a refund!

DON'T got Paypal, it will "kill off" any further help from Ebay. Just happened to me today:

from Ebay (over Facebook):
"I wish that we were able to escalate this internally as the first appeal was denied, but once a payment dispute [ Paypal, etc ] is opened that shuts off our authority as the case is then passed on to the payment institution, in this case it was PayPal. We work closely with our executive teams and work all escalations here, but if you wish to speak with someone in leadership you can reach out to our phone teams here 800-456-3229 or through our help pages on our website. ~Maranda"

You need to deal with Ebay (over Facebook)

My case is interesting, it looks like I caught Ebay DOCTORING the paper-trail:

changed it from "shipped March 10, delivered March 9" to "shipped March 10, delivered March 10"

when I pointed out the discrepancy in my Ebay appeal!

I would check your Ebay purchase details, see if Ebay is doing any "funny stuff"

If you don’t mind me asking, when did PayPal deny your claim? As soon as it was filed, or did they have to wait on a response from eBay before denying it? They told me EBay had until the 14th to respond, and if they do, they’ll have to fall back on my supporting documentation to determine whether or not they’re able to issue a refund. It seems like we both have definitive proof. I wonder why they would immediately decline yours? It’s just a terrible situation all around.

If Fedex delivered to (I'll exaggerate here) New York because the label said 'New York' and YOU live in Texas..

 

Fedex DID their job and they are NOT going to pay you one red cent to cover this. They are correct in stating 'you have to take it up with the seller as the seller is the one that did this to you.

Paypal denied my claim IMMEDIATELY, despite various documentation (implying a FAKED Fedex delivery). I think they contacted Ebay, who DENIED my appeal

I just pushed HARD on Paypal, found their community forum. Yep, there's a thread on "faked deliveries"! I went to Paypal chat/messenger, some guy is helping me. I sent him various screenshots, also this thread! He wanted VERIFICATION of faked Fedex delivery:

shipping address does NOT match my home-address

& was willing to do a 3-way call with Fedex. I called Fedex, who REFUSED to send me an email confirming above. I called Paypal via phone, & FINALLY got her to call Fedex to confirm above. Hopefully, this will end up in a REFUND!!

You paid via Paypal (tied to debit card). I believe you can get a refund ($912 is a LOT of money!!), by imitating above. See attached imageScreenshot 2023-04-06 091420.png

UNBELIEVABLE! I got a refund from Paypal

To collimille22, you need to get over to Paypal (their chat) & start a conversation. An agent was helpful,  offered to do a 3-way phone call (w/Fedex), to confirm FAKED Fedex delivery. They gave me a phone # to call

Do what I did, & tell them you got a FAKED USPS delivery. Once you send them proof, you'll get a refund. USPS did send you something?

Me, the paper-trail (Fedex) could not prove it (FAKED delivery), they wouldn't send me it via email (just orally over the phone). I called into Paypal (see above), they pushed back..AGAIN. But, I told them to call Fedex to confirm

shipping-address was NOT my home-address

by calling Fedex. JUST got the refund.. But, the crooked Ebay seller is STILL running around -- Ebay is messed up!

Hopefully, you get your $912 back!!!

Hey that’s awesome! I’m super happy for you! I’m still waiting for them to contact eBay. If they come back and try to reject it, I’ll give that a shot. I hate that it has to come down to use being mean, hateful and nasty just to get our own money back. It’s a shame how eBay is willing to treat their customers, even when it comes to these obvious scam sellers. I’ll keep everyone updated once I hear back from PayPal. I’m glad you were able to get it back!

I have never had an issue with paypal. Recently I had an issue just like this, bought something online and paid through paypal. Ended up being a scam (my fault, deal too good to be true and website was a scam) but anyway filed a INR in paypal and seller provided a tracking number showing the item delivered to my zipcode, but the tracking number showed the item shipped before I even placed the order. paypal say that and refunded my money.

Personally, I would have gone over to that business and asked for the parcel. 

After getting it, I would open a not as described claim.

WE DID IT BOYS! PayPal issued my refund today, and it’s already hit my bank. **bleep** eBay and **bleep** the fake seller who tried to steal my money. I work hard for my money, and was absolutely devastated when eBay told me they couldn’t refund it. I provided them with all of the same information, but they just didn’t believe me. If anyone has this issue in the future, please, if your package doesn’t show up, see if there is an option to request a proof of delivery form. It will show you where the package was actually delivered. USPS website doesn’t show the actual delivery address, but the proof of delivery form they provide does. It was the smoking gun in my case, and the only reason I was able to get my refund. I really appreciate all of the advice, feedback, and help. As much as I hate this website now (wouldn’t you?), the community is helpful. Thank you guys!

WOW!! You started this thread, & I jumped in with my sad story

Someone posted to contact Ebay (via FB), which was definitely an upgrade of the "standard" Ebay customer-service (chat, phone, automated response to appeal, etc). But, THAT was a no-go, if we filed a claim with payment-method (in both of our cases Paypal). But, Paypal (over chat) was the silver-bullet!

The crooked seller (in my case) is STILL running around, with others getting RIPPED OFF! I assume your seller doing the same.. This is the latest twist in crooked Ebay sellers -- FAKED deliveries! Ebay (& Paypal) need to figure out a solution FAST..they are losing $$ (& future clients)

See below, this guy got ripped off as a buyer..now HIS address is being used for faked deliveries!!

I just received a third item from one of these scammers - two cans of spray paint. I have a growing pile of cheap items with a fake return address, delivered to ME so the seller can use the tracking number to scam someone else. I do not want to be a party to this. I do not want MY name used to scam others. Each of these items which I receive with a Priority Mail tracking number represents someone who has been victimized by a broken "Resolution Center."

 

I think that PayPal is running on autopilot.
