I bought some chandeliers and the seller accepted returns. When I wanted to return them the seller refused the return, the case was won in my favour.
I ended up being refunded and keeping the items. Seller issued a civil claims against me and today we have had mediation which has failed.
The mediator told me that I can't legally keep the goods even though I was told I could do so via eBay.
Seller is now taking me to a civil courts as he wants compensation.
He was offered the goods back today but refused them.
I could well get a county court judgement against me for going acting on eBays advice I'm told that there advice is unlawful and wrong help!!!

This is a prime example of the risks buyers can take on here when they do not follow the proper procedures for a return. YOU LEGALLY cannot keep an item that was refunded to you. You just cant. You should have returned that sellers merchandise. Let this be a warning to other buyers who play this game of keeping sellers merchandise when they are refunded by Ebay. Other court cases have been documented on the internet for this behavior.

This is one of those feel good stories that is nice to wake up to. I applaud this seller, and Lord knows if they need to start a Go Fund Me for their legal expenses against you I'll be among the first to contribute. If more sellers did this maybe eBay would stop their corporate larceny.
Just so you know, eBay has no more legal standing to tell you to keep someones merchandise than I do.
Looking at your feedback left for others, I'm just taking a wild guess here and going to go out on a limb and say that getting, receiving, and keeping merchandise is probably a trend with you. I'm wondering how many of those negs resulted in sellers issuing refunds to you.
Look at it this way. With all those negs left for sellers you have to think eBay hasn't really worked out for you. And now this.
As I said at the beginning, this is all wonderful news. If the seller succeeds in getting a judgement against you and you ignore it, it will eviscerate your credit report for at least seven years. This seller is seeking their pound of flesh, and it looks like they are on their way to getting it. Yay!!!

Glad to see this happening. I hope it cost you dearly. Don't buy stuff you are just going to return. Maybe smarten up and buy stuff like this locally to be sure you want this exact item. Now you just run a seller thru the mud on a frivolous return, having them eat all the expenses related. All due to you being a immature consumer that cant make a final purchase decision. Grow up.

Yes, well said, and now this buyer is trying to blame Ebay for this when they signed an agreement by purchasing on here to not be able to really pursue any legal recourse against them. It’s strictly between the buyer and the seller when these legal cases come up and yes, these sellers have a grand chance of winning these cases in court and they certainly have. One case was just shown on the internet from a people’s court show. More and more will surely follow.

First thing I thought I saw was "LIAR" when I saw your ID.
Why do you think you should be able to keep money and the items.
This is eBay and Amazon mentality that you can have them both. I am sure you wouldn't want someone keeping your expensive ?? and getting a refund. I am sure you would be so mad.
It also looks like you should keep away from buying online.
Too bad we can't see what you "kept" from all those negative feedbacks to those sellers.
Three times three, you will get in return.

eBay has no legal right to tell you to keep an item. They have about as much legal right as I do to tell you to keep an item.

Keeping item you do not pay for is wrong .you do know that i hope
Most of eBay sellers are running business to make a living to pay bills, feeding and housing themselves and their families
As to eBay advice
if an eBay employee stated you can keep the item and receive a refund should be loose their job.

I hate to say it (actually I don't, it's about time a bad buyer gets their just desserts!) but I hope the seller bangs you like you're a 16 penny nail! Just wait until you see how much Punitive damages are!
