I bought some chandeliers and the seller accepted returns. When I wanted to return them the seller refused the return, the case was won in my favour.
I ended up being refunded and keeping the items. Seller issued a civil claims against me and today we have had mediation which has failed.
The mediator told me that I can't legally keep the goods even though I was told I could do so via eBay.
Seller is now taking me to a civil courts as he wants compensation.
He was offered the goods back today but refused them.
I could well get a county court judgement against me for going acting on eBays advice I'm told that there advice is unlawful and wrong help!!!

You need to return this sellers merchandise as it's unethical and illegal to keep both their money and merchandise. I hope the seller wins their case and all related expenses as some buyers are just a nightmare.

I doubt you have anything to worry about, other than being whom you are. Some times people can be hostile to themselves, due to an unrecognizable addiction, like in, an addiction whereas to con Another and, such an addiction might bring satisfaction and pleasure to the Addict's mind, although such an addiction is harmful to Others and Oneself, such has little bearing at the end of the fix, for the ramifications of the act are superseded by the mind's satisfaction from the fix.

The policy doesn't prevent a buyer/seller from suing each other. It's to prevent eBay from being sued themselves. They make the final decision in money back guarantee cases doesn't mean it can't be taken to court

Frankly, you seem to have more than your share of issues with the sellers that you choose to do business with here on eBay. Perhaps you should be more selective in whom you choose to do business. Of course, it may be that you would be better off purchasing from local B&M shops where you can inspect the items before committing to buy. However, owing to the current virus issue I can see where that would be difficult.

Just saying:
As for the topic: well you did as eBay said and gave the items away.
So how during arbitration did you say you would return them??
Did you recover the item??
Do you have proof the seller refused a return. If so you may have a case when it makes court.
If only "no response to a case filed with eBay" : that may or may not be enough to cover you..
Best advice: Be a great deal more careful with purchasing on eBAy: it does not seem o good method for you from the feedback you have left. You might even think about stopping purchases on line with the problems you seem to have had including this one.
Since you are not in the United States it would be best if you sought advice from some one authorized to do so with in your own judicial system; than to take and advice here.
