Unfortunately, eBay is no longer a viable selling platform for new AUTHENTIC products. Too many counterfeit products which eBay has to be aware of as you can read the counterfeit complaints in the feedback, yet the sellers are allowed to keep selling. Buyers are aware of this. eBay has thrown all its good merchants under the bus and they have left eBay. Last year Amazon did 144 billion in sales. eBay did 9 billion. eBay used to be top dog, now they are a very distant second to Amazon. I can't stand Bezos, but you have tp give him credit on stomping out the competition (eBay). I just put a new best quality product we manufacture in Europe on eBay 2 1/2 days ago.....only 4 views. Put the same product on Amazon at the same time and sold 63 units in 2 1/2 days. Amazon promotes your product, more buyers, better shipping system, etc.. Sad to see, but eBay can't compete, and although their customer service people are very polite, and professional and do the best they can to help, the upper management at eBay are totally incompetent and have no idea how to stop the financial hemmorhaging in sales revenue that is now occurring at eBay. That same management attempts to take advantage the sellers on the eBay platform. We have been on eBay 13 years, have 100% feedback score, top rated seller...and all that means nothing as eBay has become a money losing proposition. Time to move on.

In all states, state statutes take precedent over any private business policy. In Florida, any eBay policy in conflict with Florida Law becomes null and void. Ask a licensed attorney.
eBay is the "middleman" which they admit. eBay is not selling the product, and eBay is NOT buying the product. eBay simply advertises the product to be sold just like newspaper ads.

So as a retired judge/commissioner, you are allowed to keyword spam big time on Ebay? I guess its ok as long as your buyers are aware they are getting fake RayBans.

Thank you. I am aware of that. If you check their comments and look at what they are selling on eBay you'll find they have nothing for sale on eBay. As for my comment about eBay in free fall ? It's a matter of record, anyone can Google it. I just posted what a shame it is eBay has fallen so far from grace. eBay will be viable for selling used products, but like I said they can't compete selling new authentic products. I manufacture my own products internationally distributed through other corporations I own the stock in. I'm more wholesale actually, not retail. Thanks for the response.

The ad compares the Ray Ban "Aviator" quality sunglasses, versus the KG "Aggressor" quality sunglasses which there is no comparison in quality. There are only three sunglass manufacturers in the United States that manufacture sunglasses compliant with the very strict U.S. military requirements (Mil-Spec 25948J) for military pilot sunglasses. Those manufacturers are Randolph Engineering, American Optical, and Kalamata Glass of Greece (Aggressor Optical Corporation). Both Randolph Engineering, and American Optical use polycarbonate lenses. Kalamata Glass uses Trivex lenses which is a superior lens. Ray Ban quality does not come close to matching the quality of any of those three manufacturers. So the bottom line is our products certainly are NOT counterfeit.

You are using the name Ray Bans in the title. They are not Ray Bans. That is not allowed. You cannot use a brand name in an item's title or description if the item is not actually that brand name.
I am not allowed to list a purse and say "like Kate Spade" if it is not actually a Kate Spade purse.

It was in response to the knock-off comment of Amazon..
Its kinda funny we almost considered the whole upfronting the cash to the wholesale for the pallet loads to the warehouse for reselling, but years of quality control decided not to trust the unknown untested, kinda makes since on the high returns.

You're violating ray ban's trademark/intellectual property by using their name in your ad. It's also very tacky.
It does more damage to your brand's image than it does to ray ban. You should be able to see that.

What people are trying to explain to you is:

which states in relevant part:
You yourself have pointed out that your listing makes exactly such a comparison, but ebay explicitly states that that is "not allowed" and constitutes a violation of ebay's keyword manipulation policy.
Now, personally, I don't care one way or another about your listing. But I generally think it's a good idea to at least be acquainted with ebay's policies.

If eBay is just a middleman, or an ad, why do they need a license to do business in Florida? The business is being conducted by buyer or seller, not eBay, if I follow what you are asserting.

I'm a retired Florida DBPR judge/commissioner so I'm very good at reading comprehension and interpreting intent. The ad we published on eBay is a true comparison between the two products using Ray Ban Aviator's own specifications vs. KG Aggressor specifications all of which are FACT. This ad informs the potential customer of certain facts that aid them in purchasing a product. There is no derogatory, or false information stated in that ad nor the content in the add used to manipulate a listing advantage. It simply compares the two products which other sellers commonly do on eBay. So the bottom line is that policy does not apply.
The policy you cite has to do with manipulation, and the use of false information in order to gain a listing advantage. So again, the policy you cite would not apply to our listing.

So you don't have to follow the rules of ebay because you are special and you have ray ban's permission to use their trademarks in your listing?
