I ordered 2 lamps from buyer for aproximately $52 a piece. One arrived broken. I asked for a replacement as i needed 2 lamps. Buyer refunded half the money and wont communicate with me. They are still selling the same lamps, but for almost 3 times the price now. Should i not be entitled to a replacement when the item is still available ? One bedside lamp is useless to me, and im not paying $140 for the lamp that i payed $52 for.

Sellers don't have to send replacements. If you're still within the 30 days after actual delivery date, you can file a case of item not as described with ebay. You most likely will need to return the other lamp.

The seller may now be pricing items at replacement cost and not some distant acquisition costs. Or may be closing a gap between his selling price to you and what other sellers are asking for similar or matching items today.

You are entitled to the extent and limits of the sellers terms and conditions, not to your desired terms and conditions.

Sorry but you are not entitled to a replacement. That comes under seller's choice. You can file a not as described case to get the rest of your money back but you may have to send the lamp that is not broken back.
So your choice is to either find the lamp from another seller, buy it at an increased price from this seller, or file for a full refund and probably have to send the one lamp back.
Seller refunded you the money for the broken lamp, so you will not be reimbursed again for that.

Buyer protection is usually excellent on Ebay. But NOT IN THIS SITUATION! Seller knows you need that other lamp---because you are using them AS A PAIR. One without the other is useless. In my opnion this is a scam.
BUT I BELIEVE he can get away with this. UNLESS you go to the trouble filing a SNAD Dispute--and then go to trouble of re-packing the lamp you do have and sending it back to him for a refund.

Totally agree with jen_proudleowife. There is NO scam. Unfortunately, one lamp arrived broken, buyer has been reimbursed for that lamp. Buyer has choice to make do with one lamp, buy another lamp from this seller or another seller, or file a case and send back one lamp to start all over.
Sller raised prices on his inventory, which is his right to do. Buyer has right to choose solution of afore mentioned choices, which do not include a replacement.

Of couse this IS a scam. The seller deliberately raised the price of the other one---and the increase was way too high.
I needed a pair of matcvhing lamps myself a few months ago. There is NO WAY I was going to buy them on Ebay--because Ebay sellers are not always dependable--or honest. So I bought my lamps from Macy's. If one had arrived broken--I am SURE Macy's would not have played this dishonest game with me.
They would have made sure I got exactly what I needed.
There is no point in quoting Ebay's RULES to me in this situation. You may think as long as it is in the RULES no harm has been done. But this buyer HAS BEEN harmed.
And that's why more and more buyers are choosing to buy elsewhere. Including me.

If, as you say, there is no point in quoting eBay's rules to you, are you advocating that there be no rules and that each buyer or seller simply go by their own opinion. I've always thought that rules are made and set up beforehand so that each party knows what they are and how to proceed. I can't imagine how any type of sport, game or other activity can be engaged in without rules. I believe that such a condition would result in total chaos.
I fail to see how a seller could anticipate that one half of a purchase would arrived damaged, thus I don't see how it could be considered a scam. Unless, of course, the claim is that the item was damaged prior to shipment. In that case, the whole transaction would, in my opinion, be a scam.
Why the seller decided to give a partial refund, I do not know. However, if the OP was not satisfied with the partial refund, they should have opted for a full refund upon return of the entire purchase.

Perhaps this has been missed, but the buyer has been made whole as she received a refund for the broken lamp. OP can open a not as described case, send the one lamp back, and be reimbursed for that portion of the transaction, thus being made completely whole for the entire transaction. Sending the unbroken lamp back would even be at the seller's expense.
So while buyer has been inconvenienced, and is disappointed and aggravated, buyer has not been harmed, and as missjen said, seller may be out of stock and raised price as a place holder for this listing.
Buyer's right to buy wherever they please, of course.

Again there is no scam. The seller is OOS. Raising the price instead of ending the listing is unethical, yes. But the OP here was NOT scammed. Have you overlooked the most important fact here, which is that they received a refund for the broken lamp?
