I ordered 2 lamps from buyer for aproximately $52 a piece. One arrived broken. I asked for a replacement as i needed 2 lamps. Buyer refunded half the money and wont communicate with me. They are still selling the same lamps, but for almost 3 times the price now. Should i not be entitled to a replacement when the item is still available ? One bedside lamp is useless to me, and im not paying $140 for the lamp that i payed $52 for.

How do you know that the seller didn't have their supplier raise the prices so that the seller paid through the nose to get 2 lamps sent out at a loss to them, then fixed the listing so that they could still sell at a small profit?

Its possible but I think thats not the case here. I think if this was the case, the seller would have cancelled the sale rather than take the loss.

we know nothing of the seller's motives. I was just throwing that out there because soetimes assumptions aretreated like facts around here.
It seems to be a fact that the person raised the price because they're out of stock and don't want to lose their place.
Nothing here supports that.

Tsk, tsk....you know on Ebay sellers are not allowed to make a profit, or even break even! Sellers are required to lose money on every transaction. Seller profit is evil and must be abolished! Those horrible, nasty sellers....
Fact is, we don't know if that happened. We don't know why the seller still has more for sale at a higher price.
We do know the buyer was not scammed, they were made whole. They accepted a partial refund for the broken lamp instead of returning both for a full refund. That's all that can be done.

eBay is not designed to do replacements. It is designed to do refunds.

This buyer has definetly NOT BEEN MADE WHOLE. He is now stuck with a useles lamp that is only one of a pair.
This seller screwed up in the first place---by packing his shipment poorly. So that one of the lamps was broken. That was his was his mistake--not the buyer's. Because thiis happened--he should be feelling embarrassed---and he should be wiling to make sure that this buyer is not inconvenienced any further. Instead he refuses to send a replacement--and is trying to force this buyer into now paying DOUBLE the price to obtain the matching lamp that he needs--and that he should have received in the from the start. Buyer paid for a pair of lamps, but was sent only one that was not broken.
To me this issue is all about ethics.
This seller shoud do whatever necessary to give the buyer what he ordered.

Sounds like the buyer bought 2 lamps from a MQ listing - not a pair of lamps.
There is a difference.

I just looked you up and I see you have been an Ebay Member for ten years. I bet this is the first time anything like this has happened to you here! I myself, do not remember seeing a a buyer being treated this badly.
I am so relieved that when I needed a pair of matching lamps myself---I did not take a chance on buying here.
After readng what just happend to you----for sure in the future--I will not be buying anything that is s matched pair--of any items. Except from a reputable store like Bean or Macy's.
You should probably do the same.

Return the single. It isnt doing you any good and it is worthless without a match. At least get ALL your money back.

The buyer has the option of returning the lamp. There is no scam, just a BUYER who doesnt understand that ebay isnt like a B&M store and doesnt do replacements

I needed a pair of matcvhing lamps myself a few months ago. There is NO WAY I was going to buy them on Ebay--because Ebay sellers are not always dependable--or honest. So I bought my lamps from Macy's. If one had arrived broken--I am SURE Macy's would not have played this dishonest game with me.
They would have made sure I got exactly what I needed.
There is no point in quoting Ebay's RULES to me in this situation. You may think as long as it is in the RULES no harm has been done. But this buyer HAS BEEN harmed.
And that's why more and more buyers are choosing to buy elsewhere. Including me.
Unless Macy's is the OP's seller, I seriously doubt the seller has the resources of Macy's. But you are entirely in your rights to expect Macy's service from Macy's. It is unrealistic to expect Nordstrom service at the Dollar Store, for example.

The OP has not detailed how the lamps were packed so you are assuming this is on the seller. Sometimes the most well packed items can turn up broken, due to carrier issues. Surely you have heard of that.
I've been in situations on ebay where I received the wrong thing, and received my money back when I opened a dispute and sent the item back. Would I have liked them to send the right item? Yes. Did they have to do so? No, that can be cost prohibitive for many smaller sellers here that are not Macy's. I understood, and ordered it from another seller. In this situation, the seller had posted a wrong picture with the listing, and said it was a manufacturer issue. The listing is still running with the picture of the item I returned when originally it had a stock picture that was similiar but not the same.
The seller can opt to correct this by sending another lamp so the OP has a matching set, or they can simply refund half the money. They may not wish to send this buyer another lamp.
So ethics are satisfied~buyer is not out any money for the broken lamp and can return the unbroken one, at the seller's expense, so be made completely whole if that is what they wish.
As I said earlier, buyer is made whole, just not made whole the way she wanted to be made whole.

Not saying Ebay is the Dollar Store, but there are many small sellers and even individuals who sell on Ebay. To expect a replacement in some of these instances is unrealistic. Ebay Buyer Protections works, so if not happy, just return the unbroken lamp. VOILA! You will be made completely whole.

How can they file SNAD when the one lamp is good? Like I said, they didn't buy a pair - they bought 2 separate lamps. And they receved the money back for the broken one.
