money may not be released until the item has been confirmed as

"Just didn't like it" is a "Buyer's Remorse" reason which means you do
not have to accept the return on eBay. The buyer then has the option of
opening a case on PayPal which you would have to accept but at least the
buyer will have to pay the return ...
Report the phone stolen to Apple so it can be "bricked" and useless to
the thief...I mean buyer. Also, file an IC3 report (Internet Crime
Complaint Center) and mail fraud report with USPS. Provide all of these
to eBay with your appeal.
