Do I send damaged item back

I purchased. Brand new cd music set that comes with 3 CDs. One of the compartments that holds the cd I place was damaged. I requested a refund and got it. I never got a return shipping label and tryed contacting the sell and asking them where I send it back to but I got no response. I did get a message from eBay saying  the refund case has been closed. Do I send it back to the address on the package or just keep,it ?

If the seller just refunded and did not issue a return label, they don't want it back (probably not worth the cost of return postage to get the damaged item back.) And eBay says the case is closed.

If you want to send it back on your own, that's up to you, but you have no ethical or legal obligation to do so.

Sorry but I call frivolous on this complaint. I deal in audio media. Those fragile prongs break if you even look at them sideways. Unless the CD was scratched there isn't any reason to make a fuss. Around 7 out of 10 people just download the CD and use a iPod or phone to play it on the go and keep the physical CD at the house. Others will ditch the plastic case and put the CD in a carrying case. CD covers and artwork just doesn't carry the value of say the covers of LP's.

eBay automatically refunds without return of item if the seller approves it or does not answer the case in a timely manner.

 

As far as ebay is concerned, you don't need to return it. 

 

As far as the seller is concerned, we don't know 100%, but since you already messaged them and they did not answer, most likely they don't want to pay to send it back, altho they should have at least answered your message.

 

You've been an ebay member for a long time and have also sold, so you can make comparisons of seller vs buyer.

 

In the end, it is you decision on how you feel keeping it vs returning it.

The seller is probably too disgusted to even open your messages, so he does not know that you are willing to send it back.

The seller probably doesn't feel it's worth it to bother with the hassle of a return. Whether or not you want to ship the item back at your own out-of-pocket expense is up to you. Personally, I do this if return shipping isn't particularly expensive.

Of course, it's not entirely a courtesy to the seller to get back a clearly defective item that they can't possibly use or relist - they'll probably just trash it upon receipt. But if the CDs in the set are very much functional, then maybe the seller can relist the item in used condition to make up for their losses.
