I sold an item for $1000. The buyer paid for shipping and opted not to purchase insurance. The Post office lost it. Ebay refunded the BUYER, and told me I had to file a claim with the USPS, whom of course denied my claim.(No insurance) Ebay then tells me I cannot appeal their decision and to add insult to injury, charged me $398.00 in fees. What can I do. This is just wrong. No money and no item. I sold something on ebay and it cost me $398.00?! Really? Looking around, I see this has happened to seasoned sellers as well as new sellers alike. If we file a class action law suit, will they boot us off Ebay?

Ouch!, That's a tough one to swallow, But i'm afraid without insurance & ebay's decision you do not have any recourse, I all way's put insurance on larger ticket item's & I also send it with a signature delivery confirmation, It gives me & the customer some extra peace of mind, As far as a class action, I doubt it would even happen & if it did , you usually wind up with a $10 check or less with those lawsuits, I feel your pain but keep that in mind next time you sell a more expensive item, Good Luck to you.

The insurance it to protect the seller (you) not the buyer. The buyer is protected by eBay, on your dime.
I don't see what you could bring to court about that? That is stated in the rules for sellers. Just what case would you bring? Would not get to first base with that lawsuit.

What can you do?? Nothing. And no court in the land will side with you.
You didn't buy insurance.
You didn't respond to the INR.
You didn't refund the buyer so ebay had to and that is why they kept the fees.

As mentioned, you need to bring yourself up to speed on the rules that govern the venue. See link below for the User Agreement—a good starting point. All sellers give their tacit agreement to abide by these terms upon listing their first item.
Without a strong foundation on eBay policy, sellers cannot make informed decisions to best manage risk when issues arise.
As for your question, i would surmise that any serious legal action against the venue could very likely result in damage to one’s standing here. In addition, just as a heads-up, the guidelines for posting in the forums precludes such discussion if it encourages activism on the subject.

I didn't go back and reread these threads, but I recall the problem being discussed before.

sorry this happened to you, at this point in time the USPS can not be trusted with expensive items, they need to be shipped other ways. Even insurance is no sure thing at all because they may actually deliver it in a couple weeks

How do know the post office lost it?...saids who? What did tracking show? Lost in transit?
I used to live in Vegas and Pahrump probably has one post office in that little town where everyone knows everyone...unless one becomes a hermit...LOL..I do love Pahrump by the way.
So USPS ground advantage has no insurance of a shipping payment of $87.00...is this an eBay shipping made label?

The ones of mine that they have lost will hit a USPS location, get a (ghost) scan every day at 12:00 AM with no location for 3 days then nothing and then you refund the buyer, so far all 3 that they have lost recently have stayed lost.

@wcaw1786 You stated in one of the other threads you started on this same subject that the lost package is 3' x 3' x 3' and weighs 70 pounds.
Did the package weigh exactly 70 lbs or a little over or a little under? I know that 70 lbs is the weight limit for Ground Advantage so if the package was a little over that, maybe that "kicked it out" or flagged it or something.
Whatever the reason, you need to do some legwork on this and find out where that package is. File a missing mail report and follow up on it. Nothing is going to get done unless you do it and sitting around complaining in thread after thread isn't going to help.

that, and the package was obviously not 3' X 3' X 3' or it would never have been accepted by USPS.

USPS "intercept" needs to be actioned.
Otherwise, If the item turns up................... it will go to the buyer. Might anyway. Intercept is not always a success.
As the transaction is closed on eBay there is no recourse to recover any funds (buyer payment) through eBay.
