I have various third party minifigures that are NOT made by Lego that my kids don’t want anymore. I posted them as NOT being Lego, but being compatible with Lego. Not sure what I’m doing wrong because I clearly state in the descriptions that the items are NOT authentic Lego

I was hit with a Vero a long time ago, On similar mini figs that are compatible, Lego is notorious at protecting their name!, If it is not Lego you can't even mention them.

I don’t know the brand name, bought most of them at a comic con kind of event

They got taken down with a Vero notice. I don’t mention Lego at all, I’ve been putting “compatible with leading brand”
But you are still listing them in the Lego category.

But all the new ones I’ve listed I left out the word Lego.
Get them OUT of the Lego category.

I see quite a few in the "LEGO R" category and the brand in the "item specifics" says that they are LEGO brand and the description says not LEGO brand. You are setting yourself up for INADs if you don't move them from the LEGO category and remove LEGO from the item specifics. On top of that, you don't offer returns so you will lose the item and your money if someone opens an INAD case.

Here's what I would do:
Don't list the lego knockoff toys on ebay.
It would likely lead to another restriction or suspension.
The vero notice means lego considers them a trademark violation and they will probably be removed again.

So how are HUNDREDS of other sellers posting their listings and not getting flagged? And they’re all using Lego and other terms in their titles and descriptions?

How are hundreds of others getting away with their listings?

They havent been caught yet. With two billion listings on Ebay, it can take a while.

Without a link or an example it is difficult to say. There may in fact be nothing wrong with those hundreds of other listings.

List them with regular lego blocks, problem solved and mention in the listing the figure isn't lego brand but the blocks are.

When I have ambiguous stuff like that, I would just call it "Unbranded" or "Generic".
I have a few types of albums that are not in eBay's recognized list of brands, I generally list them as unbranded (for item specifics) and describe them as generic because they are of some unknown brand (and sometimes I don't even know what brand they're supposed to be).

If it looks like Lego, it might still be a trademark infringement and subject to another Vero takedown.

This one clearly says "Brand Lego"

I’ve taken LEGO, COMPATIBLE, and CUSTOM out of my descriptions and categories and relisted them. A couple were taken down last night for “counterfeit violation”. It seems like I still get flagged at random even when I leave those key words out.
