Item returned by the eBay authenticator is different from the one that was sold.

I recently sold an brand new authentic Louis Vuitton suitcase, but it failed authentication because it was listed in the wrong category. However, the authenticator still sent it to the buyer. The buyer then opened a case claiming the suitcase was fake and returned a counterfeit suitcase after it had passed through the return authentication process.

 

Has anyone else encountered a similar problem? I could really use some advice on how to effectively fight this case.

    How many folks have LV 55s luggage laying around that they can swap out for a real one.

This is what I'm getting out of this:

You listed this LV luggage under a handbags/ accessory category. 

     Goes to Authenticator and they deem it miscatergorized but they send it to the buyer ( it doesn't show that the luggage was counterfeit)

    In Sept, buyer received your luggage and used it, clearly.

    Buyer claimed it was counterfeit and sends it back to Authenticator with no tracking number.

    Authenticator received it and states this on the BOL and you than received it back from Authenticator in a used condition again clearly.

     Do I have the chain of events correct?

Here's my take. (I'm speculating.)

 

It sounds like the "miscategorized" reference simply means that the suitcase shouldn't have been listed in the handbag category. 

 

And as such, it wasn't subject to the "authenticity guarantee" program through which handbags and accessories go.

 

However it seems to me that the authenticators did give the suitcase a once-over, deem it to be genuine (though not through the AG program) and as such, forwarded it to the buyer. 

 

If they'd found it to be NAD, whether fake or not in as-described condition, it wouldn't have been forwarded but would have been returned to the seller and the listing would have been removed. That it's still viewable in the completed/sold listings means it wasn't deemed to be counterfeit. 

 

In this case, although it wasn't technically supposed to be part of the AG program, my opinion is that ebay/authenticators made it part of the program by accepting and forwarding it and therefore, they should be responsible for the return, verify that it's in the same condition, that it's the same item, etc.

Agree and so glad you came here. 

    So since the Authenticator did a courtesy overall viewing of the luggage and sent it to buyer, shouldn't they have done the same overall viewing on the return " leg" from buyer? To make sure item is in same condition?

     

     I believe the authenticator is at fault here if this scenario played out this way.

Bon, apparently buyer packaged it up and sent it back to authenticator with NO tracking and OP shows this statement further up a post. Buyer is complaining it's counterfeit ( a serious charge).

I just received pictures from the buyer claiming that the suitcase is fake. I will have the suitcase when I return home next week.

It should have never been sent at all to the buyer if it did not pass the test.
