High Selling Risk Restriction

Hello Community,

My eBay account was restricted on 10th April due to high selling risk. And eBay informed me that if there aren't any cases opened within the 30 days, they'll due manual review and I can appeal after 10th May, and there were no cases opened in this time frame. On 11th May I appealed, and received following response. Anyone who can help me, it would be very much grateful to you. eBay do owe me $700, any idea in how much time will it be transferred to my Payoneer.

Upon reviewing your account thoroughly, I’m saddened to inform you that this restriction is permanent. You will not be able to participate in any selling activities on eBay. While we know this isn't the response you wished to receive, there is no further opportunity for appeal on this decision.

Very sorry for your situation.  Since you are in Pakistan, it is hard to advise.  My suggestion would be to contact eBay customer support directly to find out what to do next.  Given what you were selling it looks like copyright infringement and eBay will not tolerate this type of selling behavior and neither will Paul Rudd.

Thanks for replying. 

Actually, I only have the email option on customer service to contact eBay, there isn't any option displayed to call eBay. Secondly the reason for copyright infringement in not an issue, many other sellers are also selling, and I am selling stock product within my own manufacturing, and the restrictions is due to High Selling Risk, If there would be an issue for copyright infringement, eBay would have just removed that listing, not my account.

Intellectual property violations are among the contributors to high selling risk.

Your Ghostbusters Listing has many irrelevant words and trademark infringements.

You cannot use the Ghostbusters name without a license. You cannot use Doctor Who when it has nothing to do with the item you are selling.

Your item specifics are an excellent example of a seller who has violated Ebay policies and can be considered a high selling risk.

If there were any delivery delays, that would be the icing on the cake.

The email makes it clear, your are permanently off the site. There is no appeal being offered and no one who you can contact who has the authority to reinstate your account.

You were restricted for violating policies, not because eBay thinks you are potentially going to violate policies.

Copyright violations could very well be part of your restriction.

I would like to tell you that all of my orders were delivered before time, I didn't had any defects on my account, while I had 2 postive feedback in the time period of restrictions. 

And while listing ghost busters jacket, I checked upon the eBay Vero list, there wasn't any ghost busters named any brands or shops in it, then how the account is violating intellectual property restrictions.

Wuxley, the Canadian mgrf of these jackets for Ghostbusters, is fierce about guarding their brand, and Ebay does not allow replicas to be sold on their site.Obviously somebody reported your jackets as fake.And you have many very unhappy customers complaining that your items were fake.

VeRo is not an inclusive list of trademarks. The list of VeRo members is a tiny fraction of the existing US trademarks and you failed to learn how US law protects trademarks.

It is too late for you to learn what you should have done. You are banned for life.

What you can do for yourself by following the above link, may not be adequate. The appropriate solution was to hire a lawyer who is knowledgeable about US trademark law who is in the US.

ANY brand name misuse is violating laws. Vero member or not.

You can't make your own product, and use a brand name, yet call it your own as you do not own the brand name.

Oh and stating that you take bank deposits is also a violation as these are  not allowed. You can't make buyer pay via Paypal either. Buyers are in charge of how they wish to pay as long as ebay approves.

Perhaps you were restricted on your other account that you posted on, and this new account got flagged due to selling fakes.

Also bypassing restrictions with a second account is a violation of policy

Actually this is my old ebay account, which was handled separately in USA. Ab Leathere has nothing to do with it, I'll contact with the account, so that you can understand that it was all good with the account

If one account is restricted, then any account you open will have the same limits. 

Did you open @ab_leathers after @leatherabrish was restricted?

In the end it doesn't really matter.

Your account isn't coming back, no matter what you try.

Your best bet is to try a different marketplace and correct the things that are illegal/violations of policy.
