Deceitful Buyer is Allowed to Return Item for full refund.

I am so angry at Ebay right now. I had a Buyer who purchased an item, then sent me an email stating that she had purchased the wrong item. She clicked too fast to secure the deal and it isn't what she wanted. I told her I had a no return policy but if she wanted to pay the shipping fee's to return the item, then I would go ahead and allow it. She files a case with Ebay and they not only gave her a full refund (so I paid for shipping TWICE), but they blantantly falsified records on top of it stating that I had not responded to the case. I have clear proof from Ebay that they received my response.  I am currently trying to figure out how to go after Ebay for at least my cost thus far.  Anyone have any experience with this type of transaction or going after Ebay?  Thank you.

You guessed right about me having a no returns policy.

You guessed wrong about me doing nothing in the case. I responded immediately to the Buyer, they didn't like the answer, so they put in a case lying about the return reason. I had proof of the original email she sent to me admitting she made a mistake. Told her I would go ahead and accept the return but she would have to pay the postage. She didn't like that answer, so turned around and put in a case and lying about the reason. I responded to Ebay stating she was lying and provided the original email she sent to me.

When a buyer files an INAD, Ebay wants you to either accept the return and provide a shipping label or refund buyer and let them keep the item.

Have a great day.

Right, buyers will do that when a seller has a no return policy.

They now if they opened the correct type of return, the seller could deny the return.

With an INAD, they know the seller can't deny it and they'll get a refund.

Have a great day.

There's no such thing as a no return policy here on eBay.  I'm so tired of hearing this......

No such thing as no returns selling in this venue.

That is where I am having hardship with this whole thing.  The pictures absolutely could not be more clear as to what the item was. I sent Ebay proof of her admitting she made a mistake when ordering it, pics that clearly showed what the item was (could not be disputed), and explained the situation. They even sent me a message stating they received my response, then under the case notes stated there was no response.  I called them because either someone processing these didn't look at the documents provided or something happened, and requested a call back from a Manager.  Have yet to receive that call.

Years ago, if there was proof from the buyer, they bought the wrong item, CS could change the return from an INAD to a remorse return, but they can't do that anymore.

Have a great day.

@bandgindustries

I'm sorry to say that in ebay's current state, whenever there is a transaction dispute, the worst human garbage of a buyer is bathed in a Holy light, while simultaneously  the seller is on trial.   Buyers can and do make up lies, make false return claims, many will return a rock or a bag of paper clips in place of the Rolex watch a seller originally sent.  All the while ebay coddles the buyer who can do no wrong.  I only wish you come on these forum pages before taking the actions you did.  Sorry this happened to you.

If a seller has a return policy, they cannot deny a return.  Having a return policy allows for a buyer to enter an honest reason for the return and if it's for remorse, they have to pay to return the item.  Sometimes a buyer will just not return it when they see that.  They can't switch the reason and file again to get their shipping paid, but when you give them a heads up via email, some will do the dishonest thing as yours did.

Over the years, most of my returns have been for remorse.

99.9% of remorse buyers use IND so they do not have to pay return shipping, just like what this person did we can only assume cause OP did not say, can't do nothing about it, doesn't matter how many messages they sent saying they bought by accident, if they file a IND they get their money back. They may have bought by accident but still the item just didn't look as good as the pictures. Thats all it takes, done deal.

Your theory is incorrect, 100% of my returns the buyer selects didn't like it or ordered by mistake. I haven't had an NAD in quite a few years since I switched my policy from returns accepted to no returns...I am not running a library. If a buyer selects a not as described return, I handle it as a seller should.

I didn't guess wrong, your response is supposed to be within the case not through eMails. So your proof will be worthless like a he said she said scenario. eBay doesn't read eMails as proof they go by what reason is selected in the return.
Sellers can claim a buyer is lying until they are blue in the face....eBay will ALWAYS side with the buyer. Period, end of story.

I have a better story. Had a buyer purchase a light fixture, arrived and gave me a positive feedback and 59 days afterwards filed a "not as described case" and Ebay gave them their money back and I never received the fixture in return. I had 100% feedback at the time and had been buying and selling for years. Never had a negative and never had a return. I miss the Ebay of the late 90's and early 2000's where common sense prevailed.

One way to increase the number of cases of buyer's remorse is a shipping charge which is high compared to the cost of the item.

Shipping to me in New England, you have some items which are not going to generate happy customers at the total cost of price plus shipping no matter what you do or do not do.

Most of these folks will choose not to buy, but some might and if they do, there is an excellent chance you will be in this situation again.

If your shipping charges are close to cost, some of these buyers will be paying more to have nothing than they will if they keep the item. It will tempt even honest people to cheat.

An ounce of prevention is worth ...

Do not list a $20+ item which costs $35 to ship and expect to have a happy buyer. You will be ahead financially if you throw it away.

did you ever respond to the open case and add the buyers comment of:  I had a Buyer who purchased an item, then sent me an email stating that she had purchased the wrong item.

@bandgindustries wrote:  "I do want to mention, I am not a seasoned Seller on Ebay.  I am a disabled person and only selling some personal unused items and items in my Fathers junk to clear out some clutter and try to recoup a few dollars. I have only sold a few things and am no way makig a large amount of money. I may not even make the amount to qualify for the IRS notification."

It is understood that you are a fairly new seller and still learning the ropes.  And there is a lot to learn.  But before getting mad at eBay, do some research (or come on to these boards as you did) and find out what went wrong and how to handle it the next time.

The fact that you are disabled has nothing to do with how you handle problems on eBay.  There are a lot of sellers on here who are old, disabled, on fixed income, or any other number of situations.  eBay doesn't care what your situation is; they only want buyers taken care of.

It doesn't matter whether you make a large amount on eBay or not.  You are still responsible for claiming any income you make on your taxes whether you get a 1099 or not, but you also have fees and selling expenses to deduct off of that.

BTW, you have a negative for cancelling a buyer's order.   That is a big no-no on eBay and you probably got a defect for that plus you probably got a defect for the situation above.  eBay can curtail selling if a seller gets too many defects.

That is true, at least you would save on the return shipping. You will lose the item and your money but who knows what you may have got back, then that just starts another headache. Sometimes it's best to just write it off and go grab a beer.

Sounds like the buyer did a charge back through their payment source.

When they do that, seller doesn't usually get their item back.

Have a great day.
