i have returned a fake NGC 1849 double eagle to the seller, it has been out for delivery for day's "saying awaiting scan" i'm 100% positive that the seller has it and is just saying that he doesn't because the postal worker didn't do his/her job and scan it. i paid $114.00 bucks for this. and it was the sellers return label. what can i do now?? anyone..   thank you

Do not talk to the seller. If 

3. the seller sent you the return label, or

1. the seller had eBay issue the return label 

@cldavi-8027 eBay will force the refund. eBay says:

 

When a buyer returns an item and it doesn't show delivered within the specified timeframe then we will look at three possible situations to determine the outcome.

1. If the buyer used an eBay return label, we will close the case in the buyers favor, regardless who paid for the return label.

2. If the buyer used their own label and they paid for it themselves, we will close the case in the sellers favor.

3. If the seller sent the buyer a label and the seller paid for it, we will close the case in the buyers favor.

If the seller bought the label they are going to get a surprise when you escalate the case.

No scan = no delivery.

You may have to go to your payment method to get relief.

As another posted....

 

If it was the sellers label, and you got an acceptance scan (which you did) the whole thing falls on the seller.

 

Seller's label = seller's responsibility.

 

Get with eBay CS, and have the return closed in your favor.

I don't see anywhere that the OP stated the 'awaiting scan' is from the beginning, or after it was accepted.

 

You are covered if it's after. 

 

Does it have an acceptance scan?

it has been out for delivery for day's "saying awaiting scan"

 

That would be what automatically appears hours after it goes out for delivery and no delivery scan is made, or if the scan does not get transmitted.
