I recently bought a special tool set. The set was listed as being unopened. However, it was not and 3 of the tools where missing. I started a return with the reason of missing parts/pieces and want a full refund after returning it. The seller responded with a partial refund of half of what I paid.
I don't want a partial refund, I want to send it back for a full refund. The set is useless to me not being complete, it was only sold in this set and not separate, its OOP, and no one ever sells the tools separately. I would have to buy another set, so I would like the whole money back.
I can ask ebay to step in after tomorrow. If I do so, will they make the seller accept the return and fully refund me?

Sounds like the seller 'offered' you a partial refund. That would be in exchange for you to NOT send it back. If you want your money back 100%, you needed to open the return with 'not as described' (I'm not sure if 'missing parts' is the same or not- but 'not as described' forces the seller to accept the refund and either pay for the return shipping label or simply refund you without you sending it back.).
Since you already opened the return- does the 'return' tell you to send it back by a certain date? You being able to ask ebay to step in will only do something if you have already sent it back and tracking on the shipping label states so.

The return request is still "ongoing". I have to wait until tomorrow to ask ebay to help. The seller offered me a partial, but I have not accepted it. It says I have until January 5th to accept it or wait until tomorrow to have ebay step in.
So, you are saying that because I chose "missing parts" I am unillegible to receive a full refund now and ebay will make me take the partial?? Because that's just really ridiculous. I need the whole money back to buy a full set somewhere else.

Do not contact or respond to the seller again. Within a few seconds, after you click to Ask eBay to step in, the eBay robot will either
-- force a full refund of your payment with no return needed, or
-- issue a prepaid return label for same after tracking shows the return.

you opened the correct return
no one is going to force you to keep it
the partial refund is just an offer and you dont have to take it
fairly soon the seller will have to make a move or you can do it and just demand a return label
you will get your chance to get all of your money back with a free return, you may have to wait 72 hours till the buyer say yes
