Have you tried clearing your browser history? Tried another browser?
If you still can't start a request then you will need to contact CS.

Usually, for me just refreshing the page takes care of most of those errors.

The site is not down, but you may be using a bad link, or the item may have been removed from the site. Have you tried the suggestions above?
Is the item listing still on the site? If it has been removed by eBay and it no longer appears in the resolution center you may have to pursue your case through PayPal or your payment method.

Ive been having the same problem for almost 2 days as well. Not specifically with the damaged item situation but in receiving the same error message from eBay. I’ve been trying to create a promotion for my store and every time I got to finalize it and make it live, or even try to save it as a draft I get that stupid “it’s not you it’s us” message saying the servers are down.

The "It's not you, it's Us" page is just a generic error message that appears any time a more specific error message cannot be returned. Often it means a link is broken or a page cannot load for some reason -- for instance if the page has changed or something is missing. If it keeps appearing when you try to use a particular feature, see if there is an alternative link you can use instead to accomplish the same task.
You may get more responses if you post on the selling board -- there are many sellers there that have encountered various selling problems on eBay and someone there may be able to offer a workaround to get your promotion started.
