So I need someone here to walk me through this process because Ebay customer service did not help me very much. I ordered an item valued at $439.99. The seller did not ship the item with a delivery signature request. FedEx delivered the package while I was not home, and it sat on my door step for who knows how long. I didn't return until 3 days later and the box wasn't there. So somebody stole the box some time between the delivery date and my return. I filed a claim with E-bay and they immediately closed the case against me and I get no refund. I called them with an appeal and I apparently have to fill out these forms and upload them, But they didn't tell me exactly what forms to complete. I got an E-mail with 3 different links, (High Value Claims, Appeals, and Escalations). All 3 links take me to the same page and it's just a blank box to type stuff in. Then the representative said I need to complete an Internet Crime Form, but I have no idea what that has to do with this.
I then filed a Claim with FedEx, but according to them, any refunds involving missing packages must go through the shipper, and then the shipper has to refund me themselves.
I just want to know who is responsible for this and who I get a refund from. I am not losing $400 because a negligent Ebay seller doesn't put signature confirmations on his items.

Well, tell her that, because she couldn't shut up about it all afternoon. That's where I came up with the $360 figure. LOL!
Tell her she owes you $360 for listening to her

No. Most definitely not. It might've been a $40 item, but she desired it the other $360 worth, so the total of her cost plus her desire was $400. (Does that count?)
Amazon purchase?
Oh.
I was just curious since the River refunded one for me a few months back. It was only like $15 tho

LOLOLOL! Very good!
Actually, I ordered and received the same item. (I live in what many in my town quite wrongly consider a "bad neighborhood," but mine was right there on my porch waiting for me.) Anyway, I'm very tempted to give her mine with a beautiful greeting card that says, "Now shut up about it, already." (Not really. She's a dear friend--who doesn't read these discussion board threads . . . )

Exactly. What an epidemic of delivered packages that were never received that would be!
Hey! I have new information. Well, a new anecdote, anyway. Just spent the afternoon with a friend of mine who told the me she had ordered something from an online retailer. She was at work when the package arrived, and by the time she got home, it was gone. The online retailer refunded her 100% of her cost--the item plus shipping. Interesting, eh?
SOME retailers MIGHT do this, at their discretion, but IMO, it is disingenuous to expect an ebay seller, who may be a small time seller, to do so. Many large retailers may not do so, even though SOME might.
Even large retailers are cracking down by revising their policies to avoid what could be abuse.

I don't think desire counts, as you don't get reimbursed for that, and there is a huge difference between a $40.00 item being reimbursed, and a $400.00 item.
That is evident.

a large corporation, assumed repeat bussiness and scams less likely, it was a very nice 'gift' on their part. i am in no way suggesting ebay sellers do the same. i am just taken back a bit buy the attitude of 'some' sellers. with the issues of items being delivered to same zip/wrong house and issues with dropshippers, delivered sometimes isnt enough! my comments may of made more sense on one of those threads but just think sellers shouldnt be so quick to dismiss. free $400.00 item for your mistake, no way! a little assistance on my end, sure. i got paid so i would help, i would even offer another at my cost, provided the paid for signature confirmation.

Its actually not at all uncommon. The river will do that, I don't know how many times as I've only had 1 package that was not delivered. (we were out front all day, it allegedly was delivered at 2pm but OnTrac never drove down our street that day). It was a $30 can of protein powder. I have a friend who's husband ordered something from J.Crew one Christmas and tracking said it was delivered but they never got it and all it took was a phone call & a replacement was sent. It was in the $300-$400 range. I'm pretty sure retailers file claims with the carrier, there's a particular brand I buy from all the time and they only use fedex in the states and they issue refunds or send replacements & then file a claim with fedex.

Well, the egg is on my face, as they say! I wasn't the only one who took you at face value, either. No worries~without a laughing smiley, or very happy smiley, it can be hard to read someone's intentions at times.
I'm serious but here you go!

Disingenuous? I, frankly, consider that to be an insult of the most extreme magnitude.

I'm being kind. I chose disingenuous instead of unrealistic. I don't want to be offensive, and of course, any seller would have the right to feel extremely insulted.

seems that the only question i have is: The seller did not ship the item with a delivery signature request.
Did the listing/seller state it would? did you ask that it would be included and paid any extra charge to seller?...
And you have reported this to the police...a stolen package? that was proven to be delievered and you know when and that you got home and it wasn't there..? a police report?

In my friend's case it was a $15 item and they told her no, since tracking showed it had been delivered. Not sure how a retailer can file a claim with a carrier when the carrier has proof of delivery.

"I then filed a Claim with FedEx, but according to them, any refunds involving missing packages must go through the shipper, and then the shipper has to refund me themselves. " < my comments were addressing this! 'IF' fedex actually did offer a refund, buyer cant get it because seller 'did their part'! not debating if they will actually get anything but the attitude lacks character. if you see an accident and nobody else there to help, do you stop and help, call 911 or just say 'not my problem'? okay, rule out helping someone you just made a profit from and focus on greed instead, 'IF' refund goes threw the seller, he can just ship another item and turn a profit a second time. probably should add delivery confirmation and mark that up too!
Refunds for missing packages are only given when there is no proof of delivery by the carrier. You can file for a refund if you mailed a package and it just disappears and is never scanned delivered, because in that case it disappeared while in custody of the carrier, whose responsibility it was to make sure it was delivered. If they have proof of delivery, they won't do anything for you, so filing a missing package claim is useless. NO carrier will do anything about an item that was stolen off YOUR porch after delivery.

@tofu107 wrote:I really think the buyer should contact Fed Exp and told them he did not get his package or get the seller to intervene, why should the seller not intervene?
why?Because he could lose a chargeback and get hit with $20 fee, thats why.
If the policy still hold,Fed exp does not offer insurance, but indemnity,$100 for non jewelry and $1000 for jewelry.
@tofu107 I am curious why you, an active seller who accepts PayPal, has not read the PayPal seller protection policy? The seller will NOT lose the chargeback and have to pay a $20 fee. The seller is covered by seller protection because they have proof of delivery. So what you said is false information.
Also, All FedEx shipments include $100 insurance for LOSS or DAMAGE.
It is against board rules to post patently false information just so you know.
first it is good to know seller can do nothing since Paypal covers his ass in case of chargeback.
second,Fed EXP does not offer insurance,it is called indemnity from the horse's mouth,so quit calling it insurance.
UPS does, and you can buy more if you like from UPS
