My bank says I can't file a chargeback because it's an ebay purchase. Does that sound right?

or are they just misinformed? I bought a totally NAD item July 30 and it's now too late for an ebay return. Messaged seller and they're ignoring me so thought I would have to go with a chargeback. Called the bank and phone rep first said I couldn't do a chargeback then finally said I could come in tomorrow and try but she didn't think it would go through.

 

I've never had to do a chargeback before and just wondering if different banks have different rules about it or my small bank is just unfamiliar with the process. I see posts on these boards all the time about ebay chargebacks so I assume it can be done

Banks have their own rules on charge backs.

This was printer ink I didn't need until yesterday, I try to keep ahead of the game and not be out of ink

 

Item was "new" 2 pack color & black. When I opened the box the color cartridge was open, used & empty, the black one was OK. the outer box had been resealed with glue. Seller has some random ink cartridges listed, some with beat up box (mine was)=== store returns, deadstock shelf pulls, etc. Nothing wrong with that sometimes you can get a good deal with that stuff.

 

My best guess; someone needed a color cartridge, went to store and bought 2 pack, replaced color cartridge with their used one & returned

 

I bought store returns by the truckload for years and I know quality control is essential, you never know what will be in a box---My favorite was the remains of a warehouse worker's lunch I found in one, man that was nasty

The Fair Credit Billing Act requires credit card issuers to allow disputes to be filed for 60 days after the billing date of the first bill the charge appeared on. That requirement only applies to purchases $50 or greater.  If your dispute meets those criteria the bank is legally obligated to accept it. If it doesn't, while many issuers have more lenient rules, there's nothing that would compel them to allow the dispute.

Ebay has it's own sets of rules. I have tried chargebacks before through banks and credit cards and got denied and they state I have to go through the website. Here is what happens. They issue a pending chargeback to your file and notifies Ebay. They get in contact with the website in this case Ebay in writing. Ebay in writing tells them you waited too long to file the NAD claim so your return time is now expired. Bank then notifies you by mail stating they will decline your chargeback request.  So you are basically where you started from and wasted time. When purchasing on Ebay you are given 30 days. That's it.

Been there before.

Bought a new item at Walmart and got home and opened the package and the item wasn't new.

I think they did the same thing, bought a new one, replaced it with their old one and glued it back up

When it was returned to Walmart, they just put it back on the shelf, not knowing the item had been replaced.

Thanks for that info and this one's just under the bar but it's not about the money ($45) I just don't like getting ripped off and I really don't like the fact that this seller is stonewalling me now. Think I'll go to the bank tomorrow and give it a try

 

Sad facts; new seller (joined in June), small seller with about 37 items listed just getting started on ebay with no concept of quality control in what they're selling or customer service in handling post sale issues that are bound to arise. The "you bought it-you got it-leave me alone" school of ebay selling

 

I've been on ebay for over 26 years (I have another account) and I don't recall ever leaving negative feedback for anyone but when this seller gets their FB maybe it will serve as a teaching aid to pay a bit more attention to what they're selling and respond to customer's issues
