Believe seller trying to scam me , need some advice

hello hello everyone,  i am a seller myself and my gut is saying this is a foul deal.

 

Situation is as goes ,

 

November 1st i bought  an item for $50 +shipping , about 30 mins later of talking with the seller, he had another one, so he relisted the item , same exact pictures , same listing , and i bought again for $50 , he said he would combine shippin . Cool he then said he actually had 1 more of this item, but i said 2 is fine for now

 

So i bought  2 items from him in 2 separate transactions , 2 transactions with unique item number ID , i paid through paypal funded by my CC

 

 

Nov 1st evening i get uploaded tracking/shipped notifcation , same tracking # for both packages, this is normal. 

 

Yesterday nov 4, i have notification of delivery,  i open my mailbox and see a medium bubble mailer and lo and behold , with only 1 of the 2 items i ordered. the mail hadn't been tampered with, professionally packed , but i bought 2 items and only have 1, same tracking, same package.  It was shipped USPS priority mail. 

 

I contact seller and letting him know of the deal and he says he sent them in 2 different packages , so i kindly responded with can i get the tracking # for the 2nd package since they are in 2 as he claims. He has yet to respond, i don't see why both wouldn't make it to me at the same time , the shared tracking # is suspicious, and the prompting of the 3rd quantity ...he has yet to list the third quantity , if he even has it

 

 

To recap,

 

Bought 2 items in 2 separate transactions from seller,

Both "shipped" and marked as delivered,  yet i only have 1 package and 1 item in said package, i am missing my second one.

 

Paid paypal with CC ,

 

What is the best way to approach this? Im giving  the second package if at all , a day or two,  but i highly doubt there is.

 

I know I won't win an INR , and a SNAD well i have nothing to send back for the second quantity which I never received. I know paypal dispute has " received empty box reason for dispute" but I've never done a pp dispute,  i want CC to be my last resort

You can combine shipments if items are in 2 or more separate orders as well. I have had people buy multiple items and pay for them separately and I can combine them on my end and send partial shipment refunds through paypal.

You can reprint the same label over and over with the same tracking number on eBay for 24 hours. Because if you print it and accidentally damage it or something it is still available to reprint.

Unfortunately, I think the only way to win in this situation would be to open a SNAD case and ask for a partial refund for the item that you did not receive or ask that the item that you did not receive be sent to you, or you return the 1 item that you received and get a full refund. I believe since you purchased the items in 2 separate transactions you would need to a SNAD case for both transactions. Or maybe you just open a case for the one you didn't receive and return the the empty package?

 

If you open an INR case I don't think you would win because there is proof of tracking and delivery, but I also think you should call eBay and explain the situation.

I don't use eBay postage.  In my program you have to agree to not use the first label before you can reprint it.  And you are charged for it, with a credit given back to you after a few weeks if it isn't used.  It seems to me that eBay must do something similar to prevent constant repeated printing of the same label.

eBay allows TEN attempts to reprint a label, with no fees or delays.  This is reasonable if somebody is having trouble with their printer (out of ink, misaligned, etc.) but does leave open the possibility for a seller to generate up to ten labels and then put them on ten  packages.  Or two labels on two packages, which might have happened here.  As noted in one of the other posts, USPS will be alerted to the duplicate when they scan the second package and will probably return it to the sender .

On eBay, you do not have to agree not to use the first label before you can print a new one. You can print it as many times as you want within 24 hours of purchasing it. The USPS website is pretty much the same, after purchasing a label you are given a pdf of the label and you can save it and print it as many times as you want. It does not really matter if a label is printed multiple times, but what matters is if more than one label with the same tracking number are dropped off at the post office. If a tracking number has already been scanned into USPS they will not accept another package with the same tracking number. The package won't scan and they will not take it if you are there in person if you drop it off I would assume that they send it back to you or discard it. If you need to void a label for whatever reason you are able to do so on ebay as long as the label have not been scanned and you will receive a refund with a few weeks.
