That is disgusting to sell items like those after they expired, You
should continue to report them. Not sure if it is illegal but definitely
not a good thing for ebay to allow such a thing.

Call customer service and have them read the message from the buyer
admitting sending the wrong item. Have them close the case in your favor
since the buyer sent you the wrong item.
