Why do I have to wait 10 days before Ebay will address and item that the seller has not shipped?

Seller promised to ship the item two times, but has not. Now the seller does not respond to messages. I clicked on 'Item has not arrived" and was told that I had to wait longer...Ebay needs to change this policy.
