Hey there @pburn ultimately the buyer should take it up with their postman and work on where to leave packages in a safe place. With this it would also depend on how and if the buyer opens a case but hopefully the item was packaged safely so there isn't any damage.

Right. Very helpful, jasmen@ebay; however, we're really asking for a definitive answer here. Could you perhaps flush out the statement:

I'm not quite sure what you mean by that. It really seems rather vague and open to the interpretation of the individual people who have posted in this thread. Could you provide a more detailed explanation?

I think it would be the seller and they would have to go after the post office for reimbursement.

So basically this isn't the seller's fault, unless the buyer files a not as described case, and then it will be.

Exactly how I understand it, seems very clear.
Seller will be expected to follow procedures of Not As Described Claim and issue a refund. Same as if item received damaged.
If it leads to having eBay be involved in forcing a refund then the seller would receive penalties and defects as per policy.
i.e. "worked like a normal one"

Seller is responsible.
I deal buying and selling with stamps. Package should be wrapped in plastic to protect from the rain
during a rainy season. Buyer usually states to me it is the rainy season and I wrap it in plastic.
When you purchase stamps online through the Post Office they are wrapped in plastic by the Post Office.
It doesn't rain 24 / 7 when a package is delivered. Not the fault of the post office if a shower happens.
It like rains every day for like 5 minutes in Florida.
Buyer would have to do the refund.
If a tornado came by and got your package wet you have to blame the tornado and not the Post Office.

Tough Call, I would say the Post Office, but if it was not insured, then unfortunately I think the Burden falls on you!, Very Unfair but none the less, It is what it is.

Well then, my most sincere apologies to @powell-memorabilia. Sellers are indeed responsible for packages that a delivery person leaves out in the rain--whether or not, apparently, the buyer has provided a safe, secure location for receipt of packages.
Just trying to @ mention anyone who expressed that the seller would not be responsible, so they know for future transactions. Sorry if I missed anyone or included anyone whose post I misinterpreted.

You are absolutely right. The buyer is responsible for a safe place for packages to be delivered and if the package had of been stollen the seller would be covered. But in this case, it may not be as easy as saying that the buyer must provide a safe place for packages.
I have a big sign on the man door on my garage that all packages are to be delivered to the front porch and I have a big red arrow on the sign that points to the front porch. But sometimes, especially if it is a fill in type delivery person [not the regulars], it is so much easier for them to leave the packages exposed and at my man door on my garage than walk the few extra feet to my covered porch.
I see that as a delivery / carrier issue if my product was damaged. I do provide a safe place for deliveries, it was the delivery person that decided to leave it in a place where it is not very secure and it is exposed to the weather.
This is a bit more of a complicated issue or can be.
