I ordered an item back in April and waited until the delivery was past due before contacting the seller. He said he had a new employee who sent the item to the wrong address. This generated a postal tracking report showing a successful delivery (but, to someone else). He promised a new shipment and a $$discount for my trouble. I waited weeks and still no shipment. Because of the difficulty, I changed my request to the seller that I wanted a refund and wrote this to him many times without a reply. Now, EBAY says the refund case request is closed, due to inactivity. I spent a long time trying to find a way to speak to someone at EBAY because none of the on-line resolution choices lend themselves to explaining/correcting my situation. I am not happy. the seller is just ignoring the whole problem caused by him and his staff and he still has my $$.

The seller most likely lied to you, and you have probably waited too long to deal with this through eBay.
If you paid via PayPal you can open a case there, however it's possible he will have a fake tracking number showing delivery in your zip code.
If you paid via a credit card, you can file a chargeback with them and you should be successful there. eBay sellers have little to no defense against them even when a buyer did get the item.
