Hello
I bought a Rolex box on eBay and it ended up being a fake one after I took it to an Authorized Rolex Dealer. The seller is claiming it is legit and he bought it from an auction.
He did not respond to the return request and now it is closed (bought it more than a month ago).
What can I do now?

You opened a not as described case on Ebay? You should have asked Ebay to step in, they would have forced a refund .Go to Paypal and open a not as described case, and escalate it, you have six months there.

Just because something is acquired at auction doesn't mean it can't be fake, because a seller says it is legit doesn't make a fake not a fake.
File a dispute with PayPal.

it said I cannot ask ebay to step in until the seller responds or the deadline ends and the deadline was June 26 for the seller to respond.
How can I dispute it with Paypal?
I paid with a credit card, not a PayPal account.

Well yeah I know it is fake. I took it to Rolex dealer and then compared the box with genuine boxes and the flaws are crazy noticeable.
I am not sure how to file a dispute with PayPal since I paid with a credit card, not a PayPal account.

That's even better. Call the number on the back of your credit card @shaheenraul and file a chargeback.

Would that pull the money out of the seller account or the credit card company will eat the loss?

Did you open up a SNAD return request? What was the reason for the return, did you select 'item not as described' or 'item is fake'? Either of those would be a SNAD return and you should have had the option to ask Ebay to step in and help, unless it has been over 30 days. If it has been over 30 days then the seller doesn't have to entertain your return even if it is a SNAD return UNLESS that seller offers 60 day returns.
Do you have a letter of authenticity to show this item is a fake? That would be what should be required, not a he said/she said type of situation. As others advised you can open a credit card chargeback however you don't want to make a habit of doing so or you'll look like a liability and card companies may eventually not wish to do business with you. The chargeback should only be used once all other options have been exhausted and should only be reserved for absolute necessities.
Yes, I opened a SNAD request. There was nowhere to choose eBay to step in. All it said is wait till the 26th of June for the seller to respond and he did not.
Unfortunately the AD does not give letters for unauthenticated items.

Each credit card issuer has a threshold below which they will pay the cardholder rather than expend the costs to pursue a chargeback.
But if the disputed amount satisfies that threshold and your card issuer pursues a chargeback, your seller will pay
1. the full refund on top of the
2. eBay and
3. PayPal* fees, plus
4. a $20 chargeback settlement fee.
*depending if your credit card was processed by PayPal or Adyen

The buyer merely needs to feel that the item doesn't seem authentic.

Thank you!
I was able to call Paypal and have them find my case by the item number and then they helped me file a dispute. They told me seller have 10 days to respond.
