I had a return request a few days ago on a item that said it was not as described item number 112854954591 the buyer said the item had a dent and was out of date. And it was out of date and had a dent as it showed clearly in the pics of the listing. This was a make a offer or buy it now with no returns. Ebay sent me a email saying I had to do the return with no explanation. I called in and had to go 4 levels deep in the staff to find out why I had to make the return, with Ebay saying yes the pics clearly shows the damage to the can and the date made on the listing pics. Come to find out ebay has changed its policy on returns now. If a buyer chooses not as described the seller must take it back , pay the return shipping and then after it is in your possession you give the buyer back all his money you can open a dispute with Ebay and if they find in your favor Ebay will refund you your money. If you do not send a return label within 5 days they let the buyer keep the item and take the money from you to pay them. I was also told it has not been posted yet but started at the end of May and will be posted later this month on Ebay . How screwed up is this. It was like pulling teeth for them to tell me this. If you want to talk to some one you need to go to the dispute resolution team. Scammers will be coming out of the woodwork for this one. Use it send it back, swap parts send it back, do not want it send it back, replace it send it back. I was told in this market place buyers should be allowed to send anything back to a seller.

ebay CS is not correct , this is nothing new this is ebay MBG and has been around for a long time.
Sellers no returns doesn't mean no returns if a buyer claims not as described
once you do get it back then you have to decide if you want to fight it out, if you lose you get a seller not resolved defect.
Again this has been around for a long time , this is nothing new.

IMO your first mistake was listing it as "New."
You might want to read this page before listing anything else as "New."

Had the same exact situation with a buyer a couple weeks back. eBay declined their return request stating it was a no refund auction & they received the exact items pictured in the listing. Buyer then went to PayPal & filed a dispute asking for a “partial” refund of the full amount & keeping, not returning the items. I went ahead & offered a refund if they would return the items, before PayPal, which always seems to find in favor of the buyer, let them keep the stuff & the money. Guess what I am getting at is there is no rhyme, reason or guidelines they adhere to, just luck of the draw as to how they handle a situation.

Based on your item condition, I believe you would lose.
you have pictures but no description stating damage & you listed as New undamaged.
A brand-new, unused, unopened, undamaged item in its original packaging (where packaging is applicable). Packaging should be the same as what is found in a retail store, unless the item is handmade or was packaged by the manufacturer in non-retail packaging, such as an unprinted box or plastic bag. I was gonna ask if either issue was even mentioned in the listing, but listing it as new says alot.
It was not new if it was dented and if it was out of date, there is no way it was new.
trying to hide behind pics needs to stop.

eBay cs was wrong. You cannot believe everything they tell you. Seriously I once had them tell me I could have a buyer revise a positive feedback and suggest I leave a false positive for a buyer. People have been having trouble winning complaints that should be slam dunks for years. It's not some new policy that allows such. It's just poor seller protection and it's existed for a while. However in your case I do not think the wrong decision was made sorry. 1. I don't know about the category you are in but generally things that are out of date cannot be listed 2. The selection of new you choose describes it as undamaged this is not true and I don't see where you stated it was damaged elsewhere. Which wouldn't matter because contradictory information also isn't allowed in the listing. It may be unused but it does not meet Ebays definitely of new

All I see in your description is a cut and paste of specs, I dont see where you mentioned dents etc.
Lots of people disable pictures on their phones to save on data charges.
So a picture is no longer worth a thousand words.

A dented item is considered in "good" condition. Most retailers would either pull and destroy a dented item or mark it down.

With the tape on it, it looks like the seller was trying to hide the damage
