How do I file a claim and get my money back on an item that was never delivered to me because it was misdelivered? IF I file an INR, eBay will revert to the tracking info which shows "Item delivered at mailbox." It wasn't.
To preemptively answer the typical questions: No one else in the household, I checked mailbox within 40-minutes of the time it was stamped as delivered, their are no porch pirates in this neighborhood and they certainly would not have been around at the time it shows delivered as it was a torrential downpour and no none of the neighbors have it.
I checked with the USPS and the GPS tracking shows that the item was scanned delivered on a different street than mine. So the USPS messed up the delivery and isn't the seller responsible for their shipper and any errors?
I have contacted the seller and heard nothing in response. Seem like I have already expended energy that the seller should have done?
So how do I work within the eBay system to get a refund?

The seller is only responsible to deliver the item to your zip code, you would not win the case.This is Usps fault, not the seller. Did you pay by cc? If so, you can try to do a chargeback,but since tracking shows delivered to your zip, I dont think a chargeback is possible.

Should USPS not recover the mis delivered item , provide ebay with a statement from USPS that acknowledges the misdelivery and inability to locate the package.
A courtesy refund from ebay is possible

Contact your post master. Your post office will then go and get the package and bring it to you. As of now the USPS don't know it delivered at wrong address.
Happens often and sellers are not to be blamed.
DO NOT WAIT DO IT ASAP

I hope you are stating a broad generality or your wish as a seller and not eBay's first policy as that would create a HUGE loophole that could be easily exploited!
Would sure like to see a reference to an article or webpage where eBay states seller only has to "get close" and not actually deliver an item! Can you help with that?

The seller is not responsible for USPS misdelivering your package.
You need to go to the PO and have them retrieve your package or try to...
The seller used the address you submitted with your order and shows delivered.
Your issue is with USPS not the seller or eBay.

I am wondering what I needed to add to this, in the original post?

Since I was already at the post office, in order to get the tracking information, the USPS is already aware of the misdelivery.
Second, can the USPS compel anyone to hand over a package that was misdelivered? Seems like the USPS "gifted" my item to someone.
But I did not hire USPS in this case, the seller did. So who takes responsibility? No one? Seems like I remember that eBay states that the seller hires the shipper and thus is responsible until the package is properly delivered. Why should I take a loss because the seller's shipping company messed up?

This loophole is exploited daily by bad sellers.
They ship something(not what was ordered) to a random address with the buyers Zip. Usually to a business. Garbage arrives. Gets scanned. Business looks at the garbage, and tosses it.

While the tracking website shows the item was "delivered" the specific GPS tracking shows that the package was marked as "delivered" to a physical location that is NOT my house. Thought that was clear from the OP?
I see so many sellers jumping in with this opinion (seller not responsible), but I do not believe that to be true. My issue is with the seller who hired USPS. They could have hired FedEx or UPS or some other shipper that didn't scr*w up! Why should I be made to suffer when I did not hire the company? Why should I loose my money when I was not given a choice of shipper by the seller?
Maybe I am wrong and someone will show me eBay policy but it sure looks like many sellers need to wake up to the reality that they are "responsible" until an item is delivered to the buyer! Delivering an item 6 blocks over, the opposite end of the same zip code or the next state are not delivering the item to the seller.

I'm a buyer here now (sold here years ago) and can confirm that a few years ago Ebay changed the rules so that buyers can no longer file INR when a package shows delivered in your zip.
As the others have said, there is a known scam with unethical sellers who ship something somewhere in the zip. There have been a few where the buyer has been able to intercept the fake item, because the buyer knows the post master. Those are few and far between though.
It is actually fairly common that a package gets misdelivered. I had one from my website over Christmas. The buyer and I spent time on the phone and the PO was able to track down where the package was misdelivered and get it back.

Hi @academic.ealim.books, while tracking information is the primary source we use for a case decision, we are able to offer protection if there is evidence that an item was not delivered to the correct address. You can open an item not received request through the Resolution Center or by contacting Customer Service directly. Be sure to provide the evidence of misdelivery in your request so your seller can review to provide you with a refund, replacement, or redelivery or so we can refer to this information if we are asked to step in.

Was it a Priority shipment, first class or parcel? If Priority then it is automatically insured up to $100.
Have you gone online and filed a claim with USPS? Just because you were at the post office and asked for GPS doesn't mean they are investigating it or retrieving your package.
Have you contacted the address to which the package was actually delivered? One of my UPS packages was delivered to an address on 6th Ave N instead of 6th Ave S. Thankfully the person who received it looked up my name in the phone book and called me.
BTW, all carriers make mistakes. We are all human.
