Good morning everyone! I purchased a nitro rc buggy for my son for $210 + $25 shipping and when USPS showed up I had a bill for $44.46 extra postage due!!! Because the seller put that the package weighed 1 ounce when it is 15lbs+. I contacted the seller and he is refusing to refund the extra postage. I contacted eBay and they suggested sending the seller a a return request and say pay extra postage of accept a full refund return. I sent eBay another message asking about the $44.46 extra postage and they responded that it is up to the seller to refund eBay isn't responsible for extra postage so how is this buyer protection if I get charged $45 and can't get it back for something that was the buyers fault/ scam to get lower shipping cost. Any suggestions??? Thank you.

Hope you left him negative feedback as he scammed you and USPS. eBay should step in for false shipping info and force him to rebate you.

If the seller refuses to send money to cover the postage, then what you should do is refuse the package so it gets sent back to him. He will have to pay the return postage in order to ransom his package. Be sure to get proof from the PO that the package had Postage Due, because you will need to cite that when you file your claim for "Item not received."
EDIT: Oops, maybe I misunderstood the original post.

Sounds like OP already accepted the package and paid the fee, so tracking will now show 'delivered' and will not change.

Thank you for the quick replies everybody. Yeah I should have refused it but I didn't as my son was really excited to get it so I paid it thinking the seller/eBay would make it right.

First, eBay is correct ... this is a failure of your seller, it is the seller's responsibility, and it is not eBay's responsibility. It is also not surprising that the seller would refuse to refund ... a seller attempting to scam the USPS by putting 1 ounce on the package is a dishonest seller.
Second, there is buyer protection on this purchase IF you refused to pay the COD bill.
Third, if you paid for the extra postage to receive it, then that decision is squarely on you ... most buyers refuse a COD package. But, since you paid for it, then you have no leverage to get paid back for that expense. Looking at this another way, you paid the $44.46 for the extra postage without first consulting the seller, so it is not reasonable to expect a seller to pay for your decision.
Fourth, the eBay Money Back Guarantee is applicable to get a refund of your original purchase price and shipping you paid to the seller (not to the USPS). Your return reason would be "Item doesn't match description or photos", with the reason being "Seller did not provide shipping for the $25 paid - item arrived with $44 COD bill".

All you can do is decide if you want to keep it or return it. Either way, I think this seller deserves negative feedback for scamming you, and attempting to scam the USPS.
(By the way, if you tried to return it, this seller is probably inexperienced enough that they might try to fight you ... if they did, then they would lose, and they would also lose $30 in eBay and PayPal fees, and have to pay return shipping.)

The seller has gotten his well-deserved negative feedback. He had been a zero-feedback seller, so now he is that oh-so-rare member with a -1 feedback rating.

Unfortunately this does not make the seller refund the postage due and if the seller accepts the return and you don't return your feedback gets removed

Do what EBay said to do. Open a return request and ask that the additional postage be sent to your PayPal.

...actually you should not receive the package at time of delivery...another way to say that you should refuse and let the package return back to sender/seller so he/she can learn a hard lesson of cheating in postage...
...then you report him/her to eBay for misconduct in business practice...
...did you take a picture of Postage Due stamp showing the amount USPS required you for payment...?...if you did, send it along with your message to the seller and eBay...
...I have seen this almost everyday...unfortunately, about 7 out of 10 packages are from eBay...sorry for telling the truth...!

...COD when a selling companies or private individual sellers sold their merchandises and shipped their packages to buyers in a binding contract that USPS on behalf of the sellers to collect the cost of purchase and shipping in one invoice from buyers...
