Buyer filed a charge back with his CC company after I denied his return request

Buyer wanted to return the item back to me after 30 days which I denied and now I got a charge back claim. Buyer said the item was defective and that it doesn't match the item description. As evidence to challenge the dispute, I had the pictures of the item which is brand new and sealed and the listing description was copied exactly from a retailer website.

 

If the item is like $200 or $300, it wouldn't bother me that much even if I lose the case, but it's a high value item and it's going to kill me if the seller ended up winning the case and keeping the item. The ebay rep I talked to wouldn't say anything to keep my hope up. Can anyone comment on cases like this? Do have stand any chance of winning the case? Am I screwed already?

Is the charge back through MP?  Is there any way that you can "accept" the charge back with the stipulation that the item gets returned to you?

The OP is a managed payments seller.  This is a "payment dispute" made by the buyer through their payment provider (paypal, credit card, etc.)   The only options a seller has in these instances is to go along with the program and refund  OR  provide a photo (jpg upload) to contest the dispute.  There is no text box, and there IS  NO RETURN FOR REFUND OPTION.   

A return is not a required for the buyer to get fully refunded from the seller's proceeds.  If they lose the "payment dispute" they get charged an additional fee, in addition to losing the item and the proceeds.

I think this is exactly what I am dealing with. Had the buyer bought the item from a retailer, the retailer usually wins in cases like this but if you are an ebay seller you are losing big no matter what. This is literally a theft. ebay collects hefty fees from this sale but just won't stand on your side, they don't even try.

Just want to know if I have any legal options here.  As the result, the fund is being frozen by ebay for 2 weeks, I am start facing financial problems, like I really need the money in order pay my rent. I never thought a single sale would have such a huge domino effect on my life, this is crazy. I am a bit scared at the same time, especially during the time we are living in. I have been in communication with the buyer and asking him to dismiss the charge back and do a return/refund instead. The buyer is not replying as of now. I am preparing for the worse I guess. The buyer is from the same state. Can I sue him and his financial institution and possible ebay for the fallout? Been thinking about this direction. Any advice would be welcomed.

EBAY DOES NOT GIVE A FLYING $#@$@ ABOUT IT'S SELLERS. YOU ARE ALONE IN THE OCEAN WITHOUT A LIFE JACKET ON THIS ONE. MP DOES NOT GIVE SELLERS ANY RIGHTS. BUYERS CAN,  HAVE , AND WILL ALWAYS OPEN DISPUTES WITH THE CC COMPAYN TO GET FREE ITEMS ON EBAY.

I've had two and not seen either item returned.

The payment dispute is likely with PP. 

 

When you open the dispute up it should say that the item will be returned to you if the dispute falls in the buyers favor and the payment will be returned to them.  

 

Chances are the buyer will have to return the item to you if they want to be repaid. This is especially true if it's through PP which it sounds like it is.

 

PP will protect you as a seller but eBay won't. MP was forced on us with little to no benefits. I'd imagine we will be seeing changes to this and more protection in the future. Why they don't force the buyer to dispute/accept the items within 7 days of it being delivered at which time they well automatically be accepted and ability for a buyer to file a return closed is beyond me. It's save so much hassel for everyone and remove the mess many of us sellers are dealing with

When a buyer files a not as described "return request" at PayPal, their seller in Managed Payments sees a "Payment Dispute" from eBay with no option to issue a label for return.

 

Then if the buyer must return the item, it will be mailed to the address on file, i.e. eBay headquarters. But eBay does not want hundreds of return packages a day arriving at eBay headquarters.

 

So how is this going to work?

um i dont think that is true. here is a dispute that I just recently went through. the only reason I know it was through PP was because the buy had said so and is likely almost always PP with disputes because of their buyer protection and the hassle of actually calling their credit card company and filing one with them. 

 

it the dispute details it says if possible the item will be returned to the address that you provided not to ebay headquarters. so id get on the phone with Paypal Screenshot 2021-05-13 1.27.20 PM.png
