he said "there was no box with the IFI Zen Can 3.  It was just a plastic zip-loc bag inside of another plastic bag. " I said "was there a paper with the tracking number on it?   You are not getting a penny from me. The post office does not work that way. I used to work at the post office, and we do not send items without a box. You are just trying to get me to give you money that you probably damaged yourself!  I am going to contact eBay as to what happened."   He said "I understand your position, but the item didn't come inside a box. It came in a Ziploc bag inside a soft plastic mailer with no padding and it was damaged. I have photo evidence and will be escalating this to eBay as an item not described. a partial refund would've been reasonable, but since you're unwilling to do that, i will let eBay step in. thank you.  Also, if I just wanted your money wouldn't I just have kept the $700 item you sent me on accident?  If you look at the photos of it on eBay, it clearly shows NO damage."

He said "according to eBay's policies I am not responsible for how the package was shipped or handled. that's between you and USPS. the item arrived damaged due to inadequate packaging and wasn't as described in the listing. I'm willing to keep the item since it works, but I just want a partial refund for the cosmetic damage. I'd prefer to resolve this with you, but I will open a case with eBay if we can't come to an agreement.

Sounds like buyer is 100% truthful and you are being defensive and rude; as well as ebay protects buyers and sounds like this one knows how the system works...so; 

 

If I were you, I would work it out with the buyer, find out what the 'partial' is they are seeking. 

 

Could be MUCH more costly to you if you don't. It's not personal; it's 'business'.

I received a shipment this way along with a USPS manifest apologizing that the box had been destroyed.

Plenty of sellers ship items without a box.  USPS does not require boxes for all shipments.   This is only the fifth item you've sold.  It's possible the ability to safely package fragile items has not matured.   It took me years to learn certain skills.   It's  recommended you not ignore any return request.

Ignore this situation at your own peril, the buyer is holding all the cards.  And I've received MANY items over the years in padded Jiffy mailers, even when that wasn't ideal packaging.

You as a seller are about to learn a painful and expensive lesson. First of all, this is NOT a yard sale. There are rules, and there is NO such thing as "no returns/refunds". eBay will just take the money from you after they refund a buyer if you do not follow the rules. 

 

The buyer seems pretty reasonable and believable. Stuff happens when USPS runs packages through sort machines. I don't care if you worked there, if you don't know what can and does happen, I have no idea what actual job you ever had there. I don't work there and I realize stuff happens. 

 

Better brush up on the rules and learn to be nicer to buyers, or your days here will be REAL short.

One thing you are going to find out very quickly about selling on eBay is that you don't get to make your own rules.  If you have "no returns" on your listings, eBay's Money Back Guarantee overrides that and if you ignore or fight a Not as Described claim, and eBay has to step in, they will give the buyer a refund from your money and probably let him keep the item, plus give you a defect for not taking care of your customer.

 

It might be in your best interest if you would take some time to familiarize yourself with eBay's Money Back Guarantee.  

 

You've only been on eBay for three or four months and have already received a negative feedback, however  it looks like this may have been a mistake.  Chances are the buyer will never see the response you left as buyers usually don't return to the feedback they left to see if there is a response.  You might try contacting him through eBay messages and ask him to revise the feedback.  If it was left by mistake, he might be willing to do that.

If the buyer files an INAD and you want it returned before refunding, accept the return and provide a shipping label.

If you get Ebay involved in a return, it won't turn out good for you.

I would start with a sincere and heart felt apology to your buyer.  Sellers are absolutely responsible to make sure the item arrives safe and sound.  When the buyer files a Request for Return, ACCEPT it right away and issue a return shipping label.  Once you get the item back, refund your buyer quickly.

 

To do anything less will only cause YOU additional problems and MONEY.  Don't fight this buyer as you are wrong about this.  You will only hurt yourself and the health of your selling account.

I am mainly a seller but as a buyer I would be absolutely stunned to get a reply like that from a seller. I know exactly what I would do to make things right because the seller (it's their job) refuses to. SMH...

I am trying to follow what happened here... You sold him the iFi Zen CAN 3 for $125 and he was unhappy with the packaging. Why is he also talking about 'the $700 item you sent me on accident'? Is he referring to the $675 Walkman that you sold the next day? You sent him that as well?

It was shipped in a box and not in a Zip-Lock bag.  The USPS did it and they should stand behind the problem.

The listing is confusing.   It's an oxymoron.   How can it be considered open box if there is no box?
