What should I do?

I sold a Wii U that was delivered 1/24.  Today I get a message saying some of the games don't work and the screen is loose.  I immediately offered a $75 refund for the games.  Upon further review the screen is loose but there are scratches and damaged all over.  

 

I attached the pic in my listing that's zoomed in.  You can clearly see zero damage.  The second pic is the one the buy submitted in the return.  It looks like it was run over!

 

My fear is EBAY will side with the buyer then I am out the money plus my console is now damaged.

 

Any advice is greatly appreciated.

Selling high value electronics = high risk

 

Submit to Ebay that you sent a new or like new condition product with pictures and deny any return or money since it is not in original condition.

If the buyer has filed an INAD and you want the items returned before refunding, accept the return and provide a return shipping label.

IMHO your fears are justified.

I smell a switcheroo coming. 

I wouldn't lie down and take it without saying something.  I would up and say should you return it that  you have pics showing no scratches and you have the serial number to compare so please double check you are returning the correct item as you report discrepancies.

1.) you cannot submit 'anything' to ebay

2.) Pictures are not accepted as any type of proof

3.) it was listed as 'used'

4.) you (seller) cannot deny a return assuming buyer opens a return with 'not as described' as the reason, which would force the seller to either refund or pay for return shipping label and then fully refund (including original shipping paid) when item tracking shows it was delivered.

See above. Since you are not Top Rated Seller or offer returns, you cannot deduct anything from the refund.

I agree with the others that you are going to get SOMEONEs device back but possibly not yours. Best you can do right now is accept the return - but I would also say in your reply that you will be happy to refund as soon as the serial number is validated as being the one that you shipped.

 

I know that is pretty much a bluff but may make the buyer think twice about pulling a swap on you - and at this point you have nothing to lose by at least saying that in a polite and businesslike manner.

 

If you do get a different device back then update us here before going further.

Your fears are well grounded. You will be required to pay return shipping on the item the seller photographed and not the unit you sent.  This a common switcheroo scam that is very common with electronic gaming items.  There are dark corners of the Internet where young male gamers openly talk about these scams.  If you sell such items then you should anticipate this type of scam and the resulting loss.  That Ebay allows inexperienced sellers like yourself, who are scam magnets,  to list such items is what is criminal.  Ebay would rather spend their money on prohibiting people from listing items that only a few people find offensive.  Welcome to our brave new world.

Has the buyer filed an eBay claim, or is this just via messages as a preliminary "shakedown"?

@ittybitnot  buyer has filed a return saying the games don't work and the screen is loose.  I have my serial number and will make him aware if a switcharoo is coming

Your serial numbers do not seem to show up in the listing.  Buyer is ahead of you and has made you aware that a switcheroo is coming.  Sorry, you are up the proverbial creek without a paddle.

Looks to me like the customer is trying to replace their own beat up one for yours, Good Luck to you!
