Dear Sir,
If we have a used Vero item (not brandnew) can we sell it on a used item listing?

If the item falls under Vero you can’t list it.

What Vero item? There are virtually hundreds of Vero rights owners.

NO. If a company does not want their item on Ebay it does not matter if it is new or used. They just do not want their item on Ebay.... period.

It's not a vero item that I have, it's a problem that came up when looking at the rules about vero items.

I'm confused to what the OP is calling a vero item. Initially I thought of an item that is the brand of a vero rights owner. For instance, if I have a used Lego set in it's retail box (which I assume is a vero item), I should be able to sell it on ebay, right? Is that what the OP is asking?

VeRO means "Verified Rights Owner."  Its purpose is to protect copyrights and trademarks against misuse such as counterfeit items.  Brand-name products can be listed if they are authentic. If an item is produced or authorized by the trademark holder, then it is OK to list, whether new or used.   

 

There are a few VeRO members who get carried away and they get eBay to cancel all listings of their items, even authentic ones, but those are a very small minority of VeRO members and they are abusing the system.

 

Here's a link to the VeRO help page.  The bottom of the page has links to VeRO member profiles, but the list is incomplete because it includes only members who have completed a profile. There are some significant omissions, such as Disney. I guess Disney figures they don't have to complete a profile to explain who they are.

If it's a legit item, shouldn't have any problems, depending on what it is.

If it's a Chinese knock off, no, you can't list it.

Yes, if the Lego item is authentic then you can list it. If it's used, then just be sure to describe it accurately (e.g, open box, missing pieces, etc.).

 

The VeRO program would be used to remove a listing that used the Lego brand name to describe an imitation product.

 

As this thread illustrates, some members believe that all products are prohibited if the brand is listed in the VeRO program, but that is not accurate.

That's not correct.

 

Items that are legal, authentic and purchased or obtained through a legitimate source (new or used) are allowed to be listed and sold on ebay.

Yea this is the misconception. But also true for some overzealous companies like LV apparently as I've read on here.

More like a MILLION (actually closer to a Billion)

 

A "Vero Item" is any item that carries a copyright, probably 90% of all manufactured goods are covered by a copyright.

 

The problem is INFRINGEMENT of a copyright not that an item has a copyright.

 

Vero is simply a name eBay gave to a process that allows copyright holders to report infringement in a quick and easy way.

 

Vero members don't have to appear on a list.

 

Non-Vero copyright holders can submit a notice of copyright infringement just like a Vero "member" they just have to do it manually instead of using the Vero bulk reporting system.
