I sell original paintings and prints of my own art. I have just noticed that someone is selling 4 of my prints and has already sold another. They did not ask my permission. They are selling cheaper and I have no idea of the quality. Yet they are using my name in the listing as if the prints come from me via that seller. How do I stop this? I want to make a complaint to Ebay but can't see how to do this. Any advise pelase. thanks

If it was my art I would have my lawyer send a quick notice to the seller.  You would need to buy one from them or have a friend buy one from them to get their mailing address.

 

BTW, I looked at your work and it is fantastic!

Are they selling illegal copies or originals of your prints?

I love your work!  Years ago when I was in collage to earn an art degree they taught us about getting a copyright on our work so no one could steal it. I notice you do have copyrights on your work. I would contact Ebay first and explain that your work has a copyright and that you will be contacting a lawyer about this if they won't make the other seller stop selling your work. It might work to also tell the seller you intend to do this.  They are breaking the law. Good luck.

That is horrible. Your art is very creative and I'm sure it has a great audience. I can't believe someone would think it okay to steal it.

 

As far as I know, the moment you finish a piece it is copyright. Tho, you have to be able to prove it.

 

Contact the seller. Tell them to stop and to turn over all moneys they made from the sales. Also report to ebay. And, if they're in the same state, consider a lawsuit.

Hi, I am a songwriter so wondering...

 

Do you, or is there a place to register your art. LIBRARY OF CONGRESS? It's true that as soon as a song is written, or art created, or book written, it's copyrighted but....

 

I do know if someone steals one of my tunes, I can stop them, at my expense, but if it's not registered, I may not be able to sue for damages. If it's registered I can seek damages and be reimbursed for attorney fees. 

 

And yes, it's important to find out.... did they print the bootleg or is it something they got from someone that got it from you? 

 

I think this is copyright infringement, theft of intellectuals and you may need a special lawyer that specializes because most lawyers have no clue with intellectual property rights. If you were working for a publisher, then you would bring it to their attention and they have special people to deal with this.

 

Also about international sales... this is a gray area with intellectuals because if an item is not registered prior to publishing, you may lose international rights. 

 

Do you have a website? If you do you can post on there about prospective buyers to be aware of those who are selling illegal prints of your works, that not only are they inferior to your own offerings, but it's just not good karma. 

 

The positive side is... you must be a great artist and should seek and likely find success securing a representative/agent/publisher for your art. You shouldn't have to worry about this as a creator. 

 

I too would be very upset, in fact flipping out, if someone were making copies of my CD's and distributing them and I wasn't benefiting from the sale of my creations.

oh, are you given credit for the creation? Do they use your name to sell the goods Or are they taking your name off? If they are, this may be a much worse offense and criminal so you may be able to get law enforcement involved if so. Prior publication and registration of your works would assist. (ok, just saw they are leaving your name on there, that's good, not good but better than if they were removing it.) I would send them a message and ask what's up?

Your brand name may be registered with ebay (VERO OWNER) so you can have any listings removed at your request of items you feel are infringing.
