Question, I had a buyer open a case against me that he has not received the item, and has no tracking. Both are true as I sent item on dec 7 from Canada and sending items to the states can take 2-4 weeks I find. The final
date of delivery is jan7 I believe if not later. Why can a case be opened this early for item not being received this far in advance of the final delivery date? I do not ad tracking as it would cost close to 14 dollars in Canada for this. My items I sell can range from 6 dollars to 100 depending on how many are ordered. I offer free shipping as most items average 20 dollars and are shipped letter mail.

By not providing tracking you cannot prove to the buyer, nor to eBay, that you actually shipped your item. No one will know until it actually gets delivered. Furthermore, as you have provided no tracking, you will also not be able to prove delivery of item. All any buyer has to do is say they never received it, and will win any case they open against you. You are setting yourself up for failure by not using tracking, regardless of the cost. Best of luck to you....

Buyer can open a case as long as the eta has passed.

Interesting postal choice......... Items are free shipping but state "free flat rate freight"........for fishing flies and have no estimated time of arrival...... so not sure how it would be handled...... If you are printing postage on Ebay, I presume that would have some delivery by date....... but as stated, no way to prove mailing or receipt, so I imagine Ebay would force a refund as soon as you can't/don't upload tracking.

Actually buyers can open cases BEFORE the estimated delivery date; basically because the system is automated and does NOT look at that date. When you answer the case with the tracking, that is when that date is looked at and if buyer opened before the date, they then receive a message telling them to 'wait' for the item as it is on its way".
But.. No Tracking; No Proof- you must refund 100%.

Okay but a refund should not be given before the eta is up? Doesn’t make sense a refund be given before final date of arrival. Postal service is very reliable I have found in my 100 or so packages sent.

But since you did not use tracking, how are you going to prove it was delivered? If you have an honest buyer, sure, but this does not sound like a buyer who will do the right thing.

You really need to start shipping with a service that shows tracking.
If you think the shipping cost is too high and will turn off buyers, increase the price of your items to build in some of the shipping cost. Then show a shipping price of the amount you think will be reasonable to the buyer.

You will have to refund the buyer.
Your way of doing it based on the high cost of "tracked shipping" appears to be a good business model.
You have saved a large amount of money by not using a service with the costly tracking. Very likely some lower price items would never have been sold if the cost of tracking needed to be added in.
Just put the refund in the "loss" column, and continue as you are knowing that you are well ahead of where you would be if paying for tracking.
Perhaps it will arrive to an honest customer.
