I just heard on the news that with the US in a State of Emergency States with Price Gouging Laws can take action against Resellers who are at fault, INCLUDING (and they Named these) both eBay and Amazon.
Now, all those threads about price gouging take on a new perspective. If the state of California has a price gouging law in place OR passes one in short order then I suspect eBay will have the authority to regulate prices sold through its venue ...

Each state could have done it before the National declaration of Emergency. Once a state declares a State of Emergency their price gouging laws kick in. So any point after that they can and do go after businesses that do this.
That is why Ebay did their ban when they did. A handful of states had declared a State of Emergency. So in an effort for Ebay to comply with those laws they implemented the ban.
With the National declaration of Emergency it does now all the federal laws on price gouging to kick in too along with the state ones.

If sold at AUCTION, then price gouging can't possibly apply - unless the seller gets caught shilling. Or gouge you on shipping.
The ending price of an auction is determined by the 2nd highest bidder. Auctions should be allowed - not that I sell any commodity stuff, though. Just auctions and just for antiques and actual vintage items.
I never use hand sanitizer or anything like that and haven't had the flu or even a bad cold in 20 years.
The more you use that stuff, the less benefit you get, and the worse for your immune system - IMHO.

Ebay would still have to police all of them to make sure the starting price was appropriate. And they just aren't going to get involved in all that. While it seems simple to you, it isn't.

Most states can take action after a local or stat emergency; they do not required a federal one. In fact, some states' websites do not even mention federal emergencies at all.
California does not require a federal declaration:

Price gouging is illegal, and the Office of the Attorney General has authority to prosecute any business that engages in price gouging after a disaster has been declared by the governor or president.

When Hurricane Sandy hit New Jersey, people complained to the state about the price gouging and the state sued the businesses. Hotels were charging around $500 a night and some gas stations were charging $4-$5 a gallon for gas. We are under a state of emergency now, so the "no price gouging" is in effect now. I think its something like you can't charge more than 10% of what you would normally charge?

Fox News was my source for this thread, they will probably replay the segment I saw several times, as is their pattern, so feel free to watch that. If you want to fact check my other posts on comparing the 2009 Swine flu and the 17,000 US deaths from that one you can, I researched it on the internet and was surprised today that those figures were broadcast on Fox News today.
Regarding the legalities of State Price Gouging Laws and this thread, had they not specifically mentioned eBay and Amazon on the news broadcast we wouldn't be having this conversation because its doubtful I would have posted on it ...
So, I am certainly not offended but felt the need to clarify my position ...

You were wrong about the federal state of emergency triggering state price gouging laws, you were wrong on your Swine Flu conclusions in a previous post, you were wrong about your statistics, also in a previous post, and your arithmetic was wrong, twice. Did you ever see that research study that concluded FOX news viewers were LESS informed than people who consume no news at all? Check it out sometime. Very illuminating.

It's not the market dictating the prices, it's sellers trying to take an advantage of the situation.

You've made your point clear on many threads that you think price gouging is okay. It won't do you any good to try and pick a fight with those who don't agree with you.

There actually IS a Federal price gouging law...
however it applies only to gasoline and other petroleum products. ( I know, not germane to this particular conversation.)
This whole situation shows the very weakness of JIT inventory. With only two or three days supplies at any given time, it doesn't take much of a rush to wipe off store shelves. That practice really needs to change.
