I'm sure ebay would be thrilled if they didn't have to set rules and punish sellers that don't follow them, they want us to manage our own accounts properly. Why have you had to cancel listings? Have you fixed your own problem?

If I remember correctly from past readings, it seems that the OP feels that refunding solves any issues and that eBay, and the buyer should be happy with that action.

It is unlikely that any lawyer will take such a case on a contingency basis, so you are likely to wait a long time.
Lawyers who take such cases do so because they expect a big payoff.
Ebay is well within the norm for its disciplinary practices, looser than many. Most Ebay sellers who reach below standard performance would be banned from other internet marketplaces for the same failures.

Legally to file for discrimination you would need to be a "protected class".
eBay sellers are not a protected class.
Further; nothing is known about the race, gender, religion, age etc... of the seller by eBay or the algorithm.
So it's a non sequitur.

You expect for eBay to allow you to have perks like promoted listings When you are below standard? eBay didn't cause you to be below standard, your bad business decisions did that.

Exactly. "Discrimination" against whom? Bad sellers? That's just good business. That stupid word gets thrown around more carelessly and stupidly than even "racist" or "fascist".
Enough with this stupid talk already. Take responsibility and run your business properly. Stop looking for excuses for self-inflicted failure/loss and fix yourself. You're denigrating and diminishing the experience of people who are facing genuine discrimination
