As a first time seller I will never sell on ebay again they have put me threw it let me tell u.so buyer paid for item package went out bam open case buyer states package not arrived 4 days before its actually supposed to be there by tracking on ebay Shipping label well then when he looses that case cuz u know u can tell by tracking its there the post office tried 3 times before he showed up at the post office and signed for it well then he take my items out and puts random stuff in my box and takes a picture of it and send it to ebay saying I sent wrong item well needless to say it's January 3rd and I shipped the package Dec 16 and still don't have my funds or item.im to the point now cuz it's not a cheap item its over 1500 that I have read the user agreement front and back and the payment policy agreement and I'm from Tennessee so the stuff they got in there won't be lawful here and u have the right to send them a demand letter stating u demand your reimbursement because u can opt out like I did of that agreement too if u don't live in a state that agrees with there termsb

You agreed to their terms when you decided to list the item.
Since you're a new seller and the item sold for more then $1000, they'll hold the funds for 30 days.
If the buyer files an INAD, saying you sent the wrong item, hate to tell you, but you'll be refunding.

Did the buyer open an Item not as described case and ask for a refund? If so , you'll be refunding.
Are your funds on hold because you are a new seller?
If you read the payment policy then you also read the payment HOLD policy too , so you know when you are a new seller and selling high ticket items your funds will be held for up to 30 days or more.
Sorry, but once you joined ebay you opted into their user agreement. It does not matter where you live , if you buy and sell on ebay you play by ebay's rules you can't make them up as you go along.
eBay going down hill? Highly unlikely.

As a new seller you should not be listing expensive items. You will, and did, attract scammers who know how to game the system. As a new seller Ebay will hold the funds for 30 days. But the odds are you will lose your item and the money. And forget about the nonsense about demand letters or opting out of the user agreement.

The Seller stands to lose a lot of money on this transaction. But if I understand the message, nothing has been sent back at this time. If buyer doesn't send it back, then the anxiety is moot. There is the possibility material could have been damaged in transit, seller can't be sure 100%. Seller has to endure the anxiety of waiting for the return. Are buyers in US?

It appears you have sold 2 of these one on the 16th of December and then one again on the 27th or did the buyer on the 16th not pay for the item? Surprised with no pictures and minimal description that the item(s) sold in the first place. You say it is new but there are no pictures of the item to help substantiate that. You also do not accept returns which you should know does NOT mean no refunds.
Curious what items they stuffed in the box that are illegal in Tennessee? You cannot simply "opt" out of the eBay user agreement. You should also take a look at the eBay MBG to understand the situation you are in.

Both of these were also listed as new but in description OP states recently serviced. Also many of the included parts were not tested even....

The pictures he took of the wrong items in the box has nothing to do with it. All the buyer has to do is SAY that you sent him the wrong items and ebay will refund the buyer (with or without you accepting the return). No picture necessary. His word is good enough.
I'm not sure who you are intending to send a demand letter to, the buyer or ebay, but you are correct, you have every right to send them a demand letter. Good luck with that. This world would be such a better place if all it took was a demand letter to solve issues.

Is it normal for eBay to “double dip” on the shipping cost? Buyer paid shipping, I “bought” the label WHILE ON THE PHONE WITH CUSTOMER SUPPORT WHOM GUARANTEED I WOULD BE REFUNDED THAT CHARGE (exact amount of shipping cost) along with the total proceeds amount when the payout hold was lifted…payout was just released, minus shipping label cost?!?!

The way it works @brredf_87 is:
- Buyer pays a lump sum: item cost, shipping, sales tax (if applicable)
- eBay takes a final value fee on the total cost.
- eBay sends sales tax to the buyer's state.
- The balance after eBay's fees and sales tax are deducted is sent to you.
- You then use the funds you received (which includes the amount the buyer paid for shipping) to pay for your shipping label. When you purchase the label through eBay they will charge you for the label, but you did receive funds to cover that charge. There is no double-dipping in the way you're describing.

Well actually there is then. From a $64.xx total price paid by buyer minus eBays “fees” and tax came to $52.38 - . 30 bc eBay is toxic charge (actually .38, apparently they just keep rounding down to the whole number, thanks) for $52 even which is shown to be my net proceeds. Only then $8.20 for the “label”/shipping leaving me with $43.80…The shipping cost was figured in initially and then again off my bottom line. Regardless of the arithmetic, I was literally on the phone with 2 different agents (successively) who clearly stated, including the numerical values, that I would be refunded the 8.20 either with the 43.80 when the hold was lifted or upon buyers receipt of the item in satisfactory condition. Whichever was later. That was pretty plain spoken English bruh and an outright, bold faced fu€king lie…and I thought the 13% was hefty. No wonder they exceeded $17B last quarter
