Appearntly I autopaid an Item that I didn't want by mistake and canceled 5 minutes after the fact and instantly started a return and messaged the seller who never responded and ebay rejected it 3 days later and closed the case. After multiple attempts of reaching out to them they did nothing and when the envelope arrive there was nothing in it! Told ebay about it and they still did nothing! Pure **bleep** customer service and leadership. I don't care what they believe I signed I didn't set up the account so I didn't agree to anything arbitrary wise. I'm getting a lawyer and I will sue them.

The only time eBay keeps fees is when a buyer opens a claim that is unresolved by the seller.
And I believe when you lose a payment dispute chargeback. Ouch!

That is the same thing. Unresolved by the Seller.

I've talked to multiple people at eBay and they all tell me that they are unwilling to help I've done everything possible to prove my case to them and they refuse to help. But this goes beyond the accident of the autopaid mishap. This is theft. I will find out who's responsible and have them prosecuted. I'm in the process of a police report I also filed a complaint with Consumer financial protection bureau and also a complaint with USPS. Ebay wants to play games and I'm not the one This is now considered a federal crime for mail tampering, so this goes beyond any arbitration or state laws. Once I get this confirmed I will sue all involved for Millions!

Yeah, I got 2 accounts both with 100% positive feedback through multiple years because I use Ebay as a playground. It's called a mistake! Inhale more oxygen before you speak next time. This is the first time this has happened and it will be the last time pal.

I hope you will come back to this selling community and keep us all apprised on your lawsuit.
You could be setting a precedent. (Or not.)

It would be the right thingto do because some people make a mistake. Good on you sir.

You would save a lot of time, money, and drama if you phone your credit card company and request a chargeback instead.

Seems eBay has followed policies.
Get that lawsuit headed in the right direction when you start it.

Nope not by a long shot. Not when theft is involved. They have neglected to do their due diligence in regard to a proper investigation into the matter.

And you aren't taking responsibility for your actions that caused the majority of the problem which caused the outcome that you don't like.
We all make mistakes. We are all human. You are typically defined by how you handle said mistakes and move forward.

I haven't read any of the 41 replies or even the entire OP, just wanted to agree -
eBay IS Scum! And not just any garden variety scum, more like the kind that floats around the edges of stagnant containment ponds and hosts naegleria fowleri. If only the entire eBay C-suite would take a swim in such a pond.

Actually, under most state statutes, tampering with the mail is a misdemeanor.
Now mail fraud, on the other hand—which more accurately defines what may have happened to you—is a federal crime and brings the full weight of the law.
A distinction may need to be drawn regarding who is the most culpable in this situation. Receiving an empty package, if it wasn’t a rifled mail incident, would be a crime: (allegedly) committed by your seller.
But lumping multiple parties together is creating some confusion. eBay didn’t defraud you, the seller did. It is the seller that bears the most accountability. But more information is needed as to what happened to the silver bars. Were they lost or stolen in transit, or did the seller deliberately fail to send them, opting to send an empty package instead?
Once you received the package minus the contents, an investigation needed to be launched with USPS. Were there any notations on the outer envelope/container upon delivery from the USPS, indicating damage to the package? And based on the listing, i think it odd that the seller sent 50 pure silver bars via First Class Mail, rather than by the more appropriate and safer Registered Mail.
Venting on the boards is practically a tradition. Unburdening oneself can be a relief, as can opening a dialog for thoughtful discourse. But reposting identical posts multiple times, threats to sue everyone “for millions,” failure to accept personal responsibility for the consequences of gaps in one’s knowledge of eBay policy, can quickly erode one’s credibility. Noted as a “word to the wise”.

Well that is hugely unfair since by your own admission you don't even know what we have been discussing.

No problem. I certainly could tell and the OP still can't seem to take ownership for their own actions that created the problem they are so mad at Ebay for.
