Ebay is Scum!!

Appearntly I autopaid an Item that I didn't want by mistake and canceled 5 minutes after the fact and instantly started a return and messaged the seller who never responded and ebay rejected it 3 days later  and closed the case. After multiple attempts of reaching out to them they did nothing and when the envelope arrive there was nothing in it! Told ebay about it and they still did nothing! Pure **bleep** customer service and leadership. I don't care what they believe I signed I didn't set up the account so I didn't agree to anything arbitrary wise. I'm getting a lawyer and I will sue them.

I would agree with the OP. They should hire 3 lawyers immediately. Watch Judge Judy as they have good commercials there to pick one from. I wish you luck! Go get 'em! Just my suggestion of offering help to the OP, nothing else.

Too many buyers out there that use eBay as a playground.  If you want it, buy it.  If you don't want it, don't bid or make an offer.  Most other platforms require a reference for payment due to all the non payers out there.  As far as an attorney goes, you won't get far and you'll be out some serious cash.  Forget about it.

Last time a buyer requested to cancel, I of course went ahead and did so refunding the buyer payment. There were no "seller fees".

When fully refunding a buyer eBay DOES NOT keep ANY portion of the fees previously charged and that (for the past year) includes the 30 cent fixed transaction fee.

 

The only time eBay keeps fees is when a buyer opens a claim that is unresolved by the seller.

Thanks for the education as its been some time since i sold on Ebay. It looks like things have changed from the old days. Just been busy working on my own website. Thanks again for the education. Well back to work and Have a Great Day 🙂

When you signed the user agreement you agree to let eBay decide. Whatever decisions they make is something in advance you agreed to abide by.

 

Your lawyer will bill you for the time spent reading the terms. Then they'll tell you that you have no case. You can't  win. Or maybe they'll tell you that you can win so they can milk you for lawyer fees.

 

After you received the empty package you needed to open a not as described case and returned that empty package. You only get one chance to open a return.

Good luck with your website.  I spent thousands of dollars and ten years maintaining multiple inventories on various platforms, including here. I finally gave up this year and put a link to my eBay store for the inventory portion of my websites. My website is used only for informational purposes now which has its' advantages. And I'm a retired IT Mgr of 33 years. Again, good luck.

You admitted to making a 'mistake' in the opening. 

 

According to the TOS, you don't have the right to cancel a placed order, simply to put in a request.

Well Thank you. But i have been living off my own website for about 7 years now. Ebay taught me a lot back in the day when Ebay use to offer their sellers to open their own personal website. I took advantage of it while working my Ebay store. Then Ebay said they where closing the personal websites that they hosted and hooked me up with Bigcommerce. That was the best thing that ever happened and I Thank Ebay every day for pushing me in that direction 🙂

FYI, just because a buyer may pay with a Credit Card does not mean it goes through PayPal.  Actually most probably do not since Ebay can and does process CC payments.

Since you don't seem to be participating in your thread, I'll see if I can help just from the info you provided.

 

Yes Ebay has made the buyer payment process very easy.  But they do ask you to verify that you actually want to purchase the item or items.  So that part is on you.  And of course, us humans make mistakes sometimes.

 

While a buyer asking for a cancellation is annoying and extra work for a seller, it is great that you did it so promptly.  The part I don't understand is why you would "instantly started a return"?  That part makes no sense whatsoever.  What did you plan to return?  You had not received anything yet?  What reason did you use to request the return?  Simply something you should not have done and added to your frustration with Ebay and your seller.

 

Your seller was likely a bit upset by your actions as it affects their selling stats on Ebay.  Sellers are held to some pretty strict metrics and you just opened a claim when there was no need to do so..

 

Yes a seller has 3 days to respond.  Ebay likely denied the claim because you had not even received the item, so there was no way you could return it.

 

Since you started out by filing a claim Requesting a Return, you can't open an Item Not Received claim now.

 

Now that doesn't excuse your seller for shipping you nothing.  That is bad behavior, but with your approach to this matter, I'm not sure there is much you will actually be able to do about that.

 

Ebay does not get involved in a He said / She said situation.  Not for a buyer or a seller.  They don't know the envelope was empty and you likely can't prove it.  So Ebay does nothing.

 

I saw the feedback you left for the seller.  That was a bit unfair.  You stated that you paid via auto pay that you did not agree to and that isn't truthful.  If items are in your cart, you first click on Go to checkout.  The next screen shows you what you are about to purchase and asks you to verify your payment method, giving you all the methods you have on file with Ebay, then you need to click the Confirm and Pay button.

 

If you used the Buy It Now button, the process is the same as it is from your cart.  But you know all this.  You are a seller too.  You are blaming this seller for some self inflicted complications.  You are mad at Ebay because they would not fix your mistake.  We all have to own the mistakes we make, or we should anyway.

 

Now that doesn't let your seller off the hook.  What they did about shipping you an empty envelope was all kinds of wrong.  I hope you will take a moment and report them.

I wish you well.  I hope this wasn't an expensive item.  But please step back, take a breath and realize this whole thing could have been handled better and likely all the bad things would not have happened.

You don't need an lawyer to sue anyone. Most likely a small claims court case.

Because OP burned that bridge already by filing a premature return request that got denied. You can only file a return once for an item. The buyer is going to have to try “something else.”
