Its a question on here as old as time. This is my first time selling on here, I took many photos and a picture of the item. Even took a video of it at ups and me sending it. (A traktor s8) much to my suprise the day it gets delivered the buyer sends photos of a complete different s8, in a different case, claiming that the pictured one is what i sent them and that its broken. They are demanding a return and due to MBG it appears as if I dont have a choice.
What are my options? I found the following photo in a seperate thread. Is allowing the return then following photo my only options?

The 50% refund is the easier and surer route if you qualify. I am pretty lenient with my buyers in most cases. If I had a case of outright fraud, I would go the police report route. That being said I have been selling for a long time and haven't been cheated through fraud yet. The only cases I read about being refunded is when sellers appealed with a police report as part of the appeal. And I believe those were seller courtesy refunds where eBay still let the buyer get away with fraud. Hopefully a history of buyer fraud reports will have eBay take action against the buyer or help if a seller wanted to bring a small claims action in court.
Normally the worse I see is when I sell electronics and the buyer is clueless about how electronics work or doesn't know what compatibility means and why it is important to check for compatibility before a purchase. Most times I sell electronics, there is no problem.

YOU really need to read the terms of service for this platform if you intend to continue to give advice on here. No need for free returns...TRS and 30 day or longer returns is all that is needed to qualify. You are welcome.

So an update for all, I called ebay letting them know what was going on before I sent the return label. They typed up a report and had me send the return label. Guy ended up sending back my case, with the broken s8 inside. Initially, ebay refunded him, but did not take the refund out of my bank account because I had already called them. I let them know the s8's had been swapped and the broken one was delivered, they sent me a thingI had to sign, and about 24 hours later I got a e-mail saying my appeal had been accepted and the $750 would go back into my ebay account. All is good(aside from shipping i had to pay both ways, but what can you do lol).

Good to hear. Unfortunately I feel that stuff like phones and video games causes more issues than other stuff. With so many options to buy a phone these days, it just seems like people run into issues with them here.

Two things happened - you called them, and you got a courtesy refund.
But IMHO the first did not necessarily cause the second.

@mybigsale - Regarding your post where you mentioned filing a police report (to report eBay fraud)... I recently purchased an item on eBay and the seller sent me a bunch of used junk, while the item I purchased was not in the box they sent. Have you by chance actually ever filed a police report for eBay fraud, and if so, could you elaborate on how to file such a report and/or maybe point me in the right direction so I can read up on how to file an eBay fraud report with the police(?) Thanks!

You don't need to do all that. Simply follow the link in your Purchase History to request a return, with the reason of Not As Described. Seller will need to either refund right away or send you a label for shipping it back.
P.S. I just saw your other post about this in the Buying group, but my comments are the same. If the seller does not respond and does not send you a return label within a few days of your opening the dispute, you can ask eBay to step in. If they have to step in, they will probably enforce a full refund to you without requiring you to ship anything back. A No Returns policy by the seller means nothing in a Not As Described dispute.

Normally I would totally agree with your reply, however, after escalating the issue with eBay, eBay replied back and is telling me I need to send the "Not As Described Item" back to the seller, even tho the seller has not returned any of my messages + the original auction listing says that the seller does not accept returns. For what it's worth, I even went so far as to include/upload photos of the "Not As Described Item" and also uploaded a copy of the USPS shipping label ... I know for a fact that the junk item that the seller shipped to me, weighed a lot less than the actual item they had listed on their auction page and were supposed to send me.
