Buyer says they received wrong item.

I sent buyer 1 oz gold coin 3 to 4 weeks ago. They opened case today saying they just got around to opening today and they say and show pictures that they received a regular Kennedy Half dollar in the box. The way I see things with everything I read is that I am out of Luck with this. Any tips or is a waste of my time trying to do anything. Thanks

Waste of time ebay doesnt care about the buyer..they only care for the sellers..I had a company do the old bait and switch..and I had screen shots to prove it ..they offered me a refund alright but only had a limited amount if time to do it..problem is I dont check my emails regularly..so I'm stuck.but the seller they just let them off Scott free..they make their money on the sellers so they care less about how many people they RIP off..I'm sticking to Amazon and let go..at least they are a honest company

You have not heard of Buyer Protection?  Ebay has great buyer protection, the MBG.  Most sellers would state that there is far more protection here for buyers than for sellers.

 

Sorry you didn't check your emails regularly and did not comply.  But cases have deadlines.  Sorry you will miss out on the greater variety and lower prices on Ebay, but good luck to you.

Your buyer has 30 days from delivery to open an Dispute on eBay.

Has that deadline passed?

If not, tell him to return the purchase for a full refund.

Do not mention shipping.

He might, because criminals are stupid*, decide that the purchase of a shipping label is too expensive or too difficult.

It's not your job to make it easy for him.

If he decides, on his own because you won't suggest it, to open an eBay dispute, you will be required to send him a Return Shipping Label.  And refund him when the tracking shows you have it back.

Ugh.

If the deadline has passed he can, if it occurs to him*, open a Dispute on Paypal for 180 days from payment.

PP will insist that he return the purchase on his own dime.

Again it is not your job to tell him how to do this.

If he manages to get it back to you, refund the original payment promptly.

 

You could go to your local police station and file a theft/fraud  report and ask that it be forwarded to  the theft /fraud division of his local police. They may have other reports already.

You could also file a mail fraud report with USPS. I have no idea how to do this, since I am not in the USA.

 

But.

No refunds without return.

And he has to show that the return happened by using Delivery of Confirmation.

If he's gonna scam you, make him work for it.

Tell your buyer to retain the packaging and all related. Inform them you will be filing mail fraud complaint and a Postal Inspector will be contacting them. Then be sure you do file with USPS. If the buyer isn't pulling a switcheroo, the package was tampered with enroute, if he is pulling a switch then he needs to be investigated.

How much was the coin? Did they sign for the package, was it insured?

Personally, I can't imagine ordering a valuable gold coin and not opening the package immediately. Is it possible a family member opened and resealed the package in the mean time, stealing and replacing the coin. Very odd to claim this weeks later.

An ounce of gold bullion goes for around $1200 these days. It's volatile, so it jumps around a lot.

Medallions and coins go for a bit more, ~$1500. I guess because the artwork is a sort of guarantee of the purity of the gold. (But not if they are Chinese Panda coins, all too many of those are just gold plated counterfeits.)

Agree with this.  I would file with USPS and further call the local PO and talk with the Postmaster.....they keep records on reported scams I'm sure...... you need to get the guy on their radar whatever happens.. and I'd let him know I was doing that.....he may disappear......   Can't guarantee you get the money back.....  but it could stop more scams from this person.......

Exactly! The MBG is so good the OP is probably going to be out $1400+ by the time all is said and done.

Just got around to opening up a $1400 coin? I don`t buy that for a minute. I`m not sure what I would do. I don`t know if you can actually file any case yet because you haven`t been defrauded yet. Does that make sense? I honestly don`t know the legalities or procedures. Is it possible you sent the wrong item?

 

If you have been the victim of fraud you can file a case with the post master general and the internet crime complaint center. If you feel your buyer is trying to defraud you, I would let them know you will be doing these things to recover your loss. IF they are trying to defraud you and know you will take action, perhaps they will rethink it.  Here is the links:

I agree that the OP should file for the insurance on his package with the USPS.

It's "obviously" been rifled during USPS handling, the contents stolen and switched.

This item appears to be sold about 3 weeks ago so we are still within the MBG time frame.  Not much you can do other than what has already been advised.

 

First I would call eBay and have a report made about the events put into the transaction details and ask about what to do when you accept a return and get back a Kennedy half dollar?  Stress that you are an experienced seller on these items and have no history of sending wrong items like the buyer is claiming.  If they can not give you clear direction, I would ask to speak to a supervisor and or a fraud and risk specialist in this area.

 

You will probably have to accept a return and get the half dollar back and then appeal the return and hope all the extra work you put in will cover you.  Make sure you have all your mail fraud reports ready to send in to eBay at this time.

 

I do not think you will be able to use the USPS insurance claim when the item is delivered?  The insurance is only for lost or damages packages and this package was delivered so the package insurance is not in play here.

This is another example of how eBay will fail to use common sense to resolve this issue. Who buys a thousand dollar plus coin and does not check it the minute they get it? A buyer like this even if refunded should be blocked from buying on eBay.
