Buyer purchases size 7 gold band , 2 days after receiving item buyer asks to return item states doesn't fit . Here comes the strange part , i looked at the buyers page on ebay and the first item for sale is the ring she/ he wants to return to me( exact same pics that she / he included in return request are in their sales listing ) . Item is listed with my exact description ( size 7) actually title is verbatim cut and paste . that being said this same person also has another gold ring a size 7 for sale . It appears to me that this person is purchasing items from other sellers and then asking for a return while waiting to seeing if the item sells , is this allowed on item ???
this could cost sellers a lot in ad fees , if this is allowed. any advice is appreciated

Doesn't that seem like a somewhat risky strategy?
What's her plan if she's told to return for refund, and if it sells immediately?
And if this progresses, are these two rings identical, so how could you be sure the one returned to you is the one you sent?

Im the seller and she/ he is the buyer , they are trying to resell the item they have asked to return not me .

I doesn't matter. This is eBay. The person can send back a rubber band instead of the gold ring, and would still be refunded.

Did the buyer file an eBay claim or just send you a message?
If the buyer filed for a return, did they actually use as the reason "didn't fit"? OR file "not as described" and say didn't fit?

The two actions wouldn't necessarily raise any flags for ebay. It sounds like they are hedging their bets on trying to make a buck without losing a buck. If it sells, then they close the return. If it doesn't sell, then they return for a refund.

I would confront her/him about it and politely ask them what they are doing.

Sounds like possibly another new scam. You probably need to report this person to eBay asap! Might look at their profile / all around feedback too. Are they selling it for less than they bought from you? They bought from you, received, and now have it listed using your photos and verbiage. I would not respond and call them out until to you talk to eBay. Probably best to through eBay Facebook page.
I will go for the worst scenario here:
Could they trying to juggle reselling the item and having an open request to commit what I would call double fraud? Meaning they sell the item and possibly turn around to send you an empty box, box with a different item, or even sending to an address in your zip code area. All of this will show delivered per tracking and the eBay bots will automatically refund them.
You lose your product, they get their money back, and then they sell the item on their site. Free item & free money!

Buying items is allowed on eBay.
Selling items is allowed on eBay.
Returning items is allowed on eBay.
Copying pictures and descriptions seems to be allowed on eBay.
I am not aware of any eBay policy that specifically says doing all four of these things with the same item is against eBay policy.

Ebay has no idea if the buyer who lists an item actually has the item in hand. Yes, it is allowed. Don't worry about it as that is the other person's problem.

If I understand the scenario correctly....
I would play it out (if I was positive it was my item being resold)....
make an offer, or buy it yourself.....see what transpires...you can always "return it"

@soh.maryl I have no clue why you are asking me a question, but I will try to answer. Did you read the scenario? The OP sold an item, and the buyer wants to return it. The OP has to accept the return per Ebay's instructions. Once the OP gets the item back the case is close and nothing further needs to happen. What the buyer does during all of this has nothing to do with the OP.
