I shipped out a completely new Xbox and it was tested before shipped out. It worked completely fine. As always things could get damaged when they get shipped. It is not my problem that it got damaged. I really can’t afford a return as the buyer wants one. I am trying to contact ebay but it says their helpline is unavailable. Let me know if anyone knows.

If you opened it and tested it, it wasn't completely new.

If the buyer files an INAD, it won't matter if you can't afford to refund, you won't have any other options.

The choice you need to make is if you want it returned before your refund.

Looks like the three items you've sold have been removed, at least they won't come up for me.

Ya see how all responses are saying if it's damaged in shipping its your problem? That's the thinking here, very sad, if in fact it's a sellers fault/responsibility for damage after it left their hands than something is very wrong with the system/partnership. Like they say you can't prove that the buyer is lying so makes ya wonder if it's even worth selling here when the platform basically holding you accountable for shipping problems.

So it should be the buyer's responsibility that the item not be damaged by the seller's shipping method of choice? How does that make any sense?

If you tested it out, it was NOT new.

All shipping issues are the concern alone of the seller on any platform. They are the only party that can file claims as they consigned the merchandise to the shipper. Not just an ebay platform thing.

Same with that other thread about the restricted account. When you click on the sold items, it has been removed.

When was the last time a seller has not been responsible for items damaged in shipment?

That's another laughable statement. Do you not realize, THAT is the law? It's the seller's responsibility to get the item safely to a buyer, in the as described conditions. Period. 

 

No one cares, including legal precedent, how you "feel" about it. As a seller, you have RESPONSIBILITES to the buyer. This platform and EVERY platform hold you responsible, because, it's the LAW. This isn't a yard sale. These sales are done with credit card payments, that extend your responsibility even more. The same consumer protection laws that apply to you and your purchases, apply to every one of your buyers. YOU are the seller, you are responsible to buyers. You can't dance around that. Neither can the OP. 

 

No matter how "unfair" you might "feel" that is, you would likely be the first one to complain if the shoe were on the other foot. We all would.
