How to handle this buyer wanting a return and falsely claiming NAD

This sale/return is regarding my very first item sold on Ebay. It is not going as I had hoped. The buyer is abusing Ebays money back guarantee by stating the item I shipped was NOT AS DESCRIBED. That is FALSE! There is no way that I as a new seller would start off engaging in fraudulent activity? The item I sold was EXACTLY as described! I also have more just like it and have offered a replacement even knowing this buyer is abusing the money back guarantee clause by making false accusations against me as a seller. This far he won’t respond. As a new seller the fraudulent activity by this buyer will in the end affect me. This is not how I intended my first sell on Ebay to go. I do not wish to refund to this buyer based on the false accusations he is making. As a seller I feel I should be protected in some way by these types of accusations. I realize now I AM NOT! I did everything according to Ebays policies and guidelines. I shipped fast. I packaged great to avoid any damage. Only to have my very first buyer make false accusations. I choose to let this be my final sale on Ebay. I do not want to be here. This is not a platform I would ever sell on again. I took a dive in after years here and finally attempted to sell an item and the first buyer pulls this. The buyer made an offer of $250 on the item already listed at $335. I accepted the offer. The buyer then immediately messages me after I accept and tries to talk me down to $200. I reply that I can’t go that low. He says “you can’t or you don’t want to” - I didn’t engage with the remark and about 30 minutes later he paid the $250 plus taxes. I paid for shipping. I went the very next day and purchased all items needed to ship out my first ever sold item. I packaged it very well. He doesn’t claim any damage other than not as described - which again is FALSE! He’s intentionally abusing the money back guarantee in order to get a refund based off of false accusations against me.

 

I don’t care if I lose out completely! I don’t even care about the money. But I want to fight this tooth and nail all based off of principles. It’s just not right. I want to do what needs to be done in order to fight this in hopes of Ebay siding with me. That would be music to my ears.  I also know that’s a long shot. But I’m willing to take it. To ensure this goes as smoothly as something like this can go, what my next step if he doesn’t reply. I’ve responded to the return by sending a message four times now. I’ve gotten no reply. I have until the 11th of September I guess to respond, which I thought responding with a message got the ball rolling, but I’m hearing nothing from him. I WANT to fight this WIN OR LOSE! I could careless on how it affects me as a seller. As I stated. I WILL NEVER sell another item on this platform or any other for that matter. I don’t want the hassle of it. I’ve already reported him for abusing the Money Back Guarantee. Now I just want to know what I need to do as a seller if he doesn’t reply? And what do I need to do each step of the way to ensure he knows I’m fighting this tooth and nail.

If you want to lose the case, money and product, do not accept the return.  No Returns, does not mean no refund.  If they opened a claim for not as described and you do not provide a return shipping label, you will lose.  Sorry

Sellers that fight return requests often lose the money, and the buyer gets to keep the item and get their money refunded. If you accept the return, you at least get the chance to get your item returned to you. Although in the case of your sale, I don't think I would trust getting a drink back, it might have been opened. I'm sorry this happened to you. Good luck.

Issue a return, you won’t be giving $refund until you receive it.  if the return isn’t how you sent it document it … as a partial return may be the resolution.  
first things first is get the product back.

I assume you had it under "no returns"? No returns does not mean no returns. Buyer can return item of course you have to pay for return shipping...You can send a return shipping label for a return.

Doing nothing by the 11th means buyer gets refund and keeps item. And there's more. Usually a seller doesn't get their funds from a first sale for 30 days. So I am thinking the refund might come out of your bank before the funds are released from the sale. I am not a 100% sure on this but I think this might be what happens.

I would do a return label for item to be returned.

Here's what might happen: buyer doesn't return it and you get the funds to keep. It sounds like buyer really wanted the item badly. I bet he doesn't return it with tracking and buyer will not get a refund. It does happen sometimes where buyers decide not to return item. 

I think the buyer is doing a "truth or dare" situation with you. Just my opinion.

Remember, buyer has to go through the process of mailing it back to you. Which is not a piece of cake to do.

You remember you had to mail this out and it was time consuming? He will have to buy tape and take it to where it has to get mailed.

I think eBay refunds the return shipping label cost if not used...but not totally sure...other moderators might be better to answer that. Good luck.

I thought about the partial refund but since it is his first sale that refund will come from his bank and not funds on hold...funds are on hold for 30 days of a new sale.

Wow! So you mean to tell me since the funds which are on hold, I believe until the 15th, they’ll deduct the refund from my information on file? I haven’t even received the funds for them to take? How do I avoid that? I have a trip coming up this month too. I wish I had never got involved with this. It’s very disappointing.

  Op has no returns policy, he is not able to deduct anything from the refund.

Thats exactly what will happen, Ebay will go to the ops payment source for the refund. It doesnt just happen to new sellers either..but any seller who does not have cleared funds in his account for Ebay to refund.

Do the shipping eBay return label. It buys you time.

And I wouldn't hold my breath for the 15th on funds being released.

I bet he doesn't return it.

Also be aware that Ebay does not look at any 'documentation', photos, videos, etc., of what was shipped, or received back as proof of anything. They can be doctored. Dont want to give the op the idea that that is a possibllity in case he decides to appeal the case.

Have you read eBay's Money Back Guarantee for buyers? It's a MUST READ source for sellers also.

And fighting it "tooth and nail" will mean that you'll lose your money, your item and probably your tooth and nail.

Keep in mind I have never dealt with this. What section of eBay do I go to handle all this? If I choose to accept the return does that start the shipping label process because I read somewhere that eBay will ship him one on my behalf. I just want to make sure I do this right.

That is a possibility, but depending upon how long that buyer has been here, and how experienced they are with returns they may just send "something" back. It might not be "it", but as we know, it doesn't have to be "it".
