Hey, so I had a buyer "return" and item to me, however they sent it to the wrong address within my same area code. Since the tracking shows that it was delivered to my area code, the appeals team automatically assumes that that means it was delivered to my address. I have contacted USPS, and they have sent me a photo of the shipping label with the same tracking number proving that the item was shipped to a different address than my own. The appeals team does nothing with this information and has continued denying any and all appeals I send them. Has this happened to anyone else? What should I do, take legal action? Appreciate any and all comments.

@kirbpodola-0 What type of item and how much was it worth? This is either a poorly handled package or a return address scam. There was a thread yesterday (I think) where the Buyer returned an item to a nearby Staples store ... well, not the actual item but probably an empty box, no return address BUT with a valid tracking number. Seller is currently out about $ 994 ...

You can try legal action (small claims) against the buyer.
Photos are never admitted as proof since they can be manipulated.

Hope it wasn't the 3070...though I'm guessing it was. GPUs are about an 11 on the 1 to 10 most scammed item scale.

fraud and theft is what this is file with proper law enforcement including theirs.
Report them to eBay : report buyer: return abuse.
Put them on your blocked bidders list.

Yeah the shipping label says it was delivered to a Wendy's within my area code. I'm out $314 right now. I sent eBay the shipping label given to me by USPS but they won't do anything.

I hope it wasn't the video card. Anyway, looks like you'll have to go the Mail Fraud/police report route. File a mail fraud report on the USPS website and a police report online in the buyers town and yours. You can also file an internet fraud report on the FBI's website. https://www.ic3.gov/
Also, get a letter on USPS letterhead stating that the item was not delivered to your address, signed by an employee with contact information. You might have to contact your local Post Master for this.
Then you'll have try to submit all those reports to eBay. Hopefully, you can find someone that cares enough to look at the evidence. If you can't do it through the Resolution Center, try sending it to them on social media.

Oh, and let the buyer know what you are doing, one you have filed the reports, and tell them to expect a visit from postal inspectors or law enforcement.

Fortunately it was not, it was a Core i7 worth $314.

Thanks for the help. Will try all of this. Thankfully it was not the video card, but it was a Corie i7 processor so I'm out $314 as of now.

Yes it has happened to me. With help from my local USPS carrier I was able to track down the return. The buyer sent a broken circuit board instead of the iPhone I had sold him. He intentionally sent the package to the wrong address to complete the return & satisfy the "delivery' requirement. It's a scam and eBay has no way to address it, primarily because you cannot make contact with anyone at eBay to explain the scam. There are many moving parts and you need to have a telephone conversation with someone at eBay HQ in the USA to take them thru the details. I could not make that happen, regrettably, because I had proof.

This just happened to me. Sold an iPhone. They opened a claim saying defective, I accepted return. They provided a tracking number. I got an auto text saying delivered, but I happened to be outside when the mail truck was there. I asked him this number says delivered, he went back 5 houses on my street and got the package. It was address incorrectly to trick the eBay system. The return item was a hair clip! I have opened a dispute and have the photos to prove, we will see what eBay says. Just terrible, been selling for 20 years, only second time I have been scammed.
