eBay Guarantee Does Not Protect Buyers from Fraudulent Sellers

I purchased some car roof racks from a seller who does not accept returns. The seller misrepresented the part number of what he was selling and the part he sent does not fit my vehicle nor match the part number he advertised.  The seller basically just replied "no" on the return request.

 

I requested a return stating wrong part number was shipped and expected an inquiry with me providing evidence of what I received and the seller countering. Nope eBay just closed the return and I'm basically on my own.

 

That eBay guarantee stuff does not appear to apply at all. That text where they say they'll ask you to present your case blah blah blah. Nope not at all. Just a case closed and you are on your own. 

 

Also, my attempt to at least provide feedback on the seller on this transaction was also deleted by facebook with apparently no recourse to warn off future buyers.

Item not as described is what you should have filed in the resolution center.

How did you pay???

Try there for relief..

Did you file and follow through on a "Item not as described" case using the MBG? If so, there is absolutely no way you could lose your money.

1) Thoroughly read the eBay MBG (money back guarantee) policy.

2) File an INAD (Item Not as Described) case. You can only file ONE case on eBay, and it must be done within 30 days after delivery.

3) Seller will have to refund, but may require you to send the item back; if so he will have to provide the label.

4) Pay close attention to timelines and steps during the case.

Do not communicate with the seller any more except via the case.
If you send the item back without a INAD case you will not be refunded.

I'm guessing you selected "does not fit".  This is a remorse return and is meant for when you get something as described but it doesn't fit what you needed it for.

I suggest you read this forum more frequently. For every one post about buyers getting screwed by sellers, there are more than 10 of sellers being screwed by buyers. 

 

As a buyer, you have more control of the situation, the only thing you need to worry about is paying on time, and providing the shipping address. 

 

As for claims, you need to submit the proper claim procedure.

Yep, and then called customer service who informed the return was closed and that eBay was going to nothing further.

Well funny you should mention that. I stated part shipped was an incorrect part number. It was a 5 inch bracket versus an 8 inch bracket. I also stated that. eBay then classified it as remorse and closed the return basically denied.

Yes because you selected "does not fit".  No matter what you say in a return it's programmed to automatically be set to remorse or not as described based on what you select.  Same is true for If a buyer selects "not as described" then says they just didn't like it it's already automatically not as described and the seller had to accept the return or eBay will do it for them.  

 

You could probably appeal with eBay.

It's really difficult to understand why this went the way it did.

You opened an item not as described case? And, then, after 96 hours, you returned to the case and asked eBay to step in?

But you stated "doesn't fit" rather than "not as described"?

It sounds to me like they selected doesn't fit but put in the details that it didn't fit because it was the size described.  Which is why the seller was able to respond with no as they put it.  Since the seller had a no return policy they can just decline when a remorse reason is selected.
