Seller listed phone as "Brand New" and "New" in and throught their eBay listing

So I recently purchased a LG V50 as I thought it was new. Their listing stated that it was brand new so I expected that it would be sealed up and untampered with.

The day I recieved the phone it came in a bubble wrapped envelope with the phone's box literally loosely placed in it with no tape. I also noticed that the sticker/screen protector on the screen was not aligned and looked like it was lazily slapped on. I saw that it booted with Android 12, when it should have came with Android 9 from the factory (I had thought the seller updated it before shipping it). Overall the phone looked in great shape though (besides the contents of the box being loose and the charger's plastic holder chipped). 

 

2nd day (Saturday March 30th) I found on a reddit post that you could see the phone's lifetime calls to see how long it's been used and as I did that I found that my V50 had 212 hours on it.

This immediately triggered me so I decided to simply request a return as "not as described", giving the reason that the lifetime call was at 212 hours where the value should be at 0 hours and solidifying the fact that the phone had Android 12 because it was a refurbished unit. I now await until April 4th for a label and/or a response.

My main concern is the fact that the seller states that any used or opened items are subject to their restocking fees. Would I be safe with the Money Back Guarantee and could I escalate with eBay if the seller won't refund me in full?

You received an item that's not as described. You have 30 days to open an item not as described case with eBay.

After you open that case, the seller has 3 days to respond.  No response? Return to the case and ask eBay to step in.  Or, if he does respond, it's supposed to be to send you a prepaid return label and to refund in full when he gets it back.  

eBay does not allow restocking fees.

After you open the case, go back and do a refresher read on the MBG and its protection.

Ebay did away with restocking fees years ago.
